On 12/20/2024, Licensing Program Analyst (LPA) Octavia Nolan and Licensing Program Manager (LPM) Luisa Gavoutian conducted an unannounced Annual Required Inspection and was met by Licensee Holly Oliveira. LPA confirmed the facility has a working telephone service at 559-788-0483. Hours of operation are Monday through Friday, 6:00 AM- 6:00 PM. LPA toured the facility indoors and outdoors, and a census was taken.

All infants are under supervision, including visual supervision, of a teacher at all times. Licensee understands that there is a ratio of one teacher supervising no more than four infants in attendance. This facility does provide infant formula or baby food to infants in care. Parents are encouraged to bring formula for their infants as well.

There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible to children. No poisons were observed during the inspection.

During the inspection, LPA observed furniture and equipment are in good condition, free of sharp, loose, or pointed parts. All handwashing facilities are in safe and sanitary operating condition. All infants changing tables are in safe and sanitary operating condition. All floors are clean and safe. All kitchen, food preparation and storage areas are clean. The facility is free of flies, insects, and rodents. Facility has one or more functioning carbon monoxide detectors that meet the statutory requirements. Solid waste storage containers have tight-fitting covers and are in good repair. Drinking water is available both indoors and outdoors. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. Fire drills are conducted and documented with the date, time and how many infant present, every six months.

Based on observation, interview, record review, the licensee did not comply with the section cited above. LPA observed that infants under 12 months of age were not sleeping in a safe environment and not placed on their backs for sleeping. Infants were observed sleeping on their sides in nursing pillows on the floor. Both infants did not have the LIC 9227 Infant Sleeping Plan completed indicating that they are capable of rolling over in which poses an immediate health, safety or personal rights risk to persons in care.

Staff placed infants in the cribs on their backs immediately. Licensee will have all infant staff read Safe Sleep regulations and sign a statement that they are aware of the regulations. Licensee will email the statements to LPA by 12/23/2024. Licensee is participating in the Technical Support Program (TSP) and will request additional training on Infant Safe Sleep as well.

Facility has seven crib infants enrolled. LPA observed there is one crib or play yard for each infant in care. The cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. Licensee provided documentation of the physical checks on sleeping infants every fifteen minutes. Staff documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness, and labored breathing. Infants can be visually observed through an open door if sleeping in a separate room. Individual Infant Sleeping Plan is completed and in file for each infant up to 12 months of age. During today's inspection, LPA observed that infants under 12 months of age were not sleeping in a safe environment and not placed on their backs for sleeping. At naptime, two infants were observed sleeping on their sides in nursing pillows on the floor. The infants were covered with blankets. One infant was sleeping with a pacifier that had an attachment. Both infants observed on the floor did not have the LIC 9227 Infant Sleeping Plan completed indicating that they are capable of rolling over.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Upon notification from the Department, Licensee will comply and act immediately to terminate the employment of, remove from the facility or bar from entering the facility for any person it is deemed necessary while the Department considers granting or denying an exemption. Capacity and limitations as specified on the license are being maintained.

At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. During record review, all staff have mandated child abuse reporting training. The name of the child care center director or fully qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day.

LPA reviewed a sample of infant files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. The Infant files reviewed include Infant Needs and Services Plan and Individual Infant Sleeping Plan. LPA reviewed a sample of staff files and observed files were complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training. Staff providing care to infants meet the education requirements.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations. LPA discussed Reporting Requirements as outlined in the regulations (Section 101212).

LPA Octavia Nolan informed licensee Holly Oliveira that this report dated 12/20/2024 documents one Type A
citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or
personal rights of children in care.

Also, LPA Octavia Nolan informed the licensee to provide a copy of this licensing report dated 12/20/2024
that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Licensee was provided a copy of appeal rights. A notice of site visit (LIC 9213) was given and must remain posted for 30 days. This report shall be made available to the public upon request. Exit interview conducted and report was reviewed with Licensee Holly Oliveira.
