On 8/2/2022, Licensing Program Analyst (LPA), Ruby Ocegueda conducted an unannounced Annual Required Inspection and was met by Licensee, Alcia Ratcliffe. Also present was Assistant #2 (S2). Days and hours of operation are Monday through Friday 6:00 AM to 6:00 PM.

LPA toured the home inside and outside and a census was taken. Upon arrival, LPA Ocegueda observed adult #1 eating at the kitchen table. Licensee denied adult #1 resided at the home and stated he was only visiting, however upon further inspection of the home and in an accessible bedroom near the bottom of the stair case, LPA observed men’s clothing, a photo of adult #1 and a projector that was turned on indicating recent use. LPA reviewed the requirement to ensure all adults receive a criminal record clearance or exemption before residing in the home. LPA showed licensee that she had been notified that Adult #1 and Adult #2 had been denied criminal record clearance and did not complete the criminal record exemption process via a letter. Current facility sketch reviewed and Licensee confirmed that the kitchen, one bathroom, living room, open office area, and day care room are used for providing care and are accessible to children. Swimming pool is fenced per regulation. The pool gate is self-latching, self-closing and opens away from the swimming pool. No windows or doors have direct access to the pool area. There are no firearms or ammunition on the premises. Outside there was one accessible poison (Raid insect killer) and inside an unlocked shed there was a gasoline container. Also inside the accessible bathroom, was various accessible cleaning products (Lysol, Fabuloso brand cleaner and Bleach).

There are no fireplaces or open face heaters in the home. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. Stairs are fenced or barricaded when children under age 5 years old are present. Safe toys and play equipment are observed. The home has working telephone service and LPA confirmed the phone number is 559-782-1175.

Based on observation the licensee did not comply with the section cited above. Outside there was accessible Raid insect killer without any child safety lock on the nozzle. Licensee placed it in an unlocked shed that also had a red gasoline container on the floor. In the accessible restroom, there was Bleach on the counter and cleaning supplies under the sink (Fabuloso, Lysol toilet bowl cleaner and Scrubbing Bubbles shower cleaner). This poses an immediate risk to the health, safety or personal rights risk to persons in care.

Licensee locked the shed after reviewing the regulation indicating the requirement to lock poisons. Licensee removed the cleaning supplies from under her bathroom sink and placed them in a locked closet. Licensee also completed a written statement indicating that she understood that poisons should be locked and that hazardous items such as cleaning supplies should be made inaccessible to all children in care at all times.

Based on observation and interview, the licensee did not comply with the section cited above. Adult #1 was observed eating and sitting at the kitchen table upon LPA arrival. Adult #1 left immediately after LPA arrival. LPA inspected the whole house and found that a downstairs bedroom had a closet full of mens clothing, mens shoes, a projector screen that was on and a photo on the wall of adult #1. LIcensee denied that adult #1 lived in the home. Adult #1 and an Adult #2 had been previuosly denied a criminal record clearace and adult #1 and adult #2 had not proceeded with a criminal record exemption. This poses an immediate health, safety or personal rights risk to persons in care.

Licensee stated she would not allow any uncleared adult (adult #1 and adult #2) to reside in the home as of today or be present while day care chidlren are in care. Licensee understands that additional civil penalties could be assessed for repeat violations if it is determined that adult #1 and or adult #2 are residing in the home or present in the home with day care children. During discussion about safe sleep regulations, licensee stated she places an infant (child #2) who is over 6 months old, on his/her side for sleeping along with a small sheer blanket. A blanket and pillow were observed inside the crib that infant #2 uses. The infant was not in care during the inspeciton. Based on observation, the licensee did not comply with the section cited above. While inspecting the accessible yard, LPA observed a broken swing set and rust on another swing set. There was also a glass fish tank with debris as well as a dirty toy car and a loose cement block near the toy car. There was an accessible empty glass bottle. Inside was an infant (child #2) who was inside an infant rocking chair and an exersaucer jumper in the accessible office area. This poses a potential health, safety or personal rights risk to persons in care.

Upon inspection of the sleeping equipment, LPA observed that there was a blanket and pillow inside a crib that licensee stated she uses for care. Licensee admitted to using blanket and placing an infant on his/her side instead of his/her back as required. Licensee also did not have required LIC 9227 (Individual Infant Sleep Plan) and required 15 minute sleep log. LPA also observed infant #2 who was awake using an infant rocking chair upon LPA arrival. There was an “exersaucer” jumper in the accessible office area. LPA discussed Safe Sleep Regulations with licensee and written resources were provided.

Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. The outdoor play area in the backyard is fenced and was inspected today. In addition to the the poison observed outside, LPA also observed a broken swing set, debris inside a glass fish tank, a lose cement brick and dirty toys with cob webs as well as an accessible empty glass bottle. LPA discussed these observations with licensee. Capacity as specified on the license is being maintained.

LPA reviewed a sample of children’s files and observed files were complete with emergency information as required. Licensee’s Mandated Reporter Training was completed on 5/21/2021. Licensee’s pediatric CPR/First Aid expires on 4/25/2023. Assistant #2 had expired Mandated Reporter Training. Licensee did not maintain immunization records at the facility. LPA reviewed the requirement to maintain all records and forms available for review of the Department.

Incidental Medical Services (IMS) are not currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D). A 500.00 civil penalty was assessed toady. Licensee was provided a copy of appeal rights.

Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 was given to licensee.
