25 | On 6/1/2023, Licensing Program Analyst (LPA) Ocegueda conducted an unannounced case management inspection. The purpose of the inspection was to inspect the newly added pool gate on the side of the home. LPA met with licensee Lorraine Anaya, toured the home and took a census.
On 5/23/2023, During an annual inspection, Licensing Program Analyst (LPA) Ocegueda observed that there was no pool fence on the side of the home. There were bedroom windows leading to a pathway that led to the pool area. After interviewing licensee and reviewing past case management reports, it was evident that this was likely licensed in this condition. Licensee and assistant/husband voluntarily agreed to put up a rod iron gate. LPA went over the specifications and regulations for fencing and pool fences and gates. On 5/23/2023, licensee also voluntarily completed a written statement agreeing to keep the bedroom doors that could potentially lead to the side of the home locked until the proper fence was installed.
Today, LPA measured the rod iron fence that was added on or about 5/25/2023. From the ground to the top, the pool fence measured 58 inches in height (4ft 10 inches) not the 60 inches or 5ft requirement in height. Licensee and assistant/husband volunteered to raise the gate to ensure it measured 5ft from the ground. The openings between the rod iron rods did measure the required 4 inches. The pool gate was tested and did self-close, self latched, and opened away from the pool. The pool fence now has four self-latching gates.
Licensee stated she would voluntarily submit photos to the Department showing the newly installed fence was 5ft in height as required.
Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiencies are cited today.
LPA conducted an exit interview with licensee Lorraine Anaya. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
