On 8/12/2022, Licensing Program Analyst (LPA), Ruby Ocegueda conducted an unannounced Annual Required Inspection and was met by Licensee, Alma Nunez. Also present was Staff #2 (S2). Licensee is Spanish Speaking and LPA Ocegueda assisted with interpretation. Days and hours of operation are Monday through Saturday 4:00 AM – 6:30 PM.

LPA toured the home inside and outside and a census was taken. Current facility sketch reviewed and Licensee confirmed that the kitchen, bathroom, and living room are used for providing care and are accessible to children. Today, licensee requested that the two bedrooms belonging to her children be made accessible. LPA inspected the bedrooms today (including closets) and did not observe any hazards. Licensee updated her facility sketch today. LPA inspected the swimming pool gate directly outside connected to the accessible play yard and was functioning per the regulation. The gate that was outside of the master bedroom, was left open and was not self-latching. The master bedroom door was closed, but unlocked. The sliding glass door from the master bedroom leading to the open gate was locked. The gate that was left open was then tested and was observed to not be self-latching. Licensee confirmed this observation. There are no firearms or ammunition on the premises. All poisons are kept in a locked storage area. No poisons were observed during the inspection. Under the accessible kitchen sink was Dawn detergents and sample paint in a plastic bottle. In the accessible kitchen drawer was one knife. Under the accessible bathroom sink there was Scrubbing Bubbles brand bathroom cleaner. Licensee removed all the potentially hazardous items and placed them in inaccessible areas.

The fireplace located the living room #2 is made inaccessible by a screen and will not be in use during daycare hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There are no stairs in this home. Safe toys and play equipment are observed. The home has working telephone service and LPA confirmed the phone number is (559)789-6276. Report continued to 809-C.

Based on observation the licensee did not comply with the section cited above. Upon inspection of the accessible kitchen sink cabinet, LPA Ocegueda found sample paint in a plastic bottle, and dawn detergents. In an accessible kitchen drawer, LPA found a knife. In the accessible bathroom bottom sink cabinet there was scrubbing bubbles cleaner. This poses a potential health, safety or personal rights risk to persons in care.

Today, Licensee removed the cleaning products, paint and knife and placed them in inaccessible areas. Licensee was reminded that these items and all potentially hazardous items should always be inaccessible to day care children. Deficiency cleared today.

Based on observation, the licensee did not comply with the section cited above. Upon inspection of the pool and gates, LPA Ocegueda observed that there was a pool gate open. The open gate was directly outside of the master bedroom. Today, the master bedroom was closed but unlocked. The sliding glass door leading to the open gate from the master bedroom was locked. Licensee stated she usually has the pool gate closed but accidentally left it open. Licensee stated that the bedroom door is usually locked, but today it was unlocked. Upon further inspection of the gate, it was observed that the gate was not self-latching. This poses a potential health, safety or personal rights risk to persons in care.

Today, licensee closed the pool gate and locked the master bedroom door. Licensee stated that she would make the gate directly outside of her master bedroom self-latching and that she would maintain her master bedroom inaccessible by way of lock or doorknob safety cover. A return inspection will be required.

Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.

LPA discussed Safe Sleep Regulations with licensee. There is one crib or play yard for each infant in care, cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. Provider physically checks on sleeping infants every fifteen minutes and will start to document on infant nap log. Infants can be visually observed through an open door if sleeping in a separate room. Individual Infant Sleeping Plan was not completed today, and LPA discussed this requirement. Infants up to 12 months of age are placed on their backs for sleeping.

Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. LPA observed a child use a bouncer today, LPA discussed this observation with licensee as well as acceptable equipment for infants. The outdoor play area in the backyard is fenced and was inspected today. Capacity as specified on the license is being maintained.

LPA reviewed a sample of children’s files and observed files were complete with emergency information as required. Licensee’s Mandated Reporter Training was completed on 8/18/2021. Licensee’s pediatric CPR/First Aid expires on 7/7/2023. A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis and measles.

All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home.

Incidental Medical Services (IMS) are not currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D) Licensee was provided a copy of appeal rights.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
