25 | On 10/28/2022, Licensing Program Analysts (LPA’s) Ruby Ocegueda and Daniel Alvarez conducted an unannounced Plan of Correction (POC) inspection for the purpose of inspecting the mesh pool gate and the wrought iron fence that was just recently added. LPA’s met with licensee Maria Bermudez. A tour of the home was conducted, and a census was taken.
On 10/11/2022, Licensee was cited a Type A deficiency under regulation 102417 (g)(5) due to not having a pool gate as required by Title 22 regulations (see 809 report dated 10/11/2022).
On 10/12/2022, Licensee submitted photos and video to the Department as proof that she had placed a mesh pool fence up, however the fence gate did not appear to be self-closing.
Today, LPAs Ocegueda and Alvarez inspected the back yard, mesh pool fence and a new wrought iron gate near the pool bar area to help confirm it was safe and followed the Title 22 requirements for pool fences. It was observed that the mesh pool gate and the wrought iron gate doors were self-closing and self-latching and measured 5 ft in height. Today, LPA’s confirmed that the in ground pool was made inaccessible.
Licensee was reminded to monitor all pool gates to ensure all parts were functioning in accordance to the Title 22 regulations. Deficiency cited on 10/11/2022 was cleared.
An exit interview was conducted with licensee Maria Bermudez.
Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, no deficiency is cited today. |
