25 | On 10/28/2022, Licensing Program Analysts (LPAs) Ruby Ocegueda and Daniel Alvarez conducted an unannounced Plan of Correction (POC) inspection for the purpose of inspecting a fence and gate that is meant to make the in-ground pool inaccessible. LPA’s met with licensee Laura Magallon. A tour of the home was conducted, and a census was taken.
A previous inspection on 9/30/2022 of the gate was not possible as it was temporarily not installed and licensee was cited a Type A deficiency under Title 22 regulation 102417(g)(5), (see report 809 dated 9/30/2022). On 10/1/2022, licensee submitted videos and photos to the Department of the gate being placed back on her porch area.
Today, LPA’s Ocegueda and Alvarez visually inspected the fence and gate in person to ensure it was safe and followed the requirements of Title 22 regulations related to the inaccessibility of pools and bodies of water. The following was observed: the white metal fence that encloses the back-yard porch area is approximately 8 ft high and has metal see through material that does not obscure the view of the pool. The gate door swings away from the pool and is self-latching and self-closing. Today, LPA’s verified that the pool is now inaccessible to children in care.
Licensee was advised that she should contact the Department before removing her gate for any reason and reminded licensee of the requirement of the inaccessibility to bodies of water while day care children are in care.
Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiency is cited today.
This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
