On 4/14/2022, Licensing Program Analyst (LPA) Theresa Marquez provided complaint findings regarding the above allegations. LPA met with licensee Margarita Madrigal. Assistant Maria Rodriguez was also present.

During the course of the investigation, LPA conducted interviews with staff and parents. Interviews revealed there was insufficient information to determined that licensee failing to provide a safe and comfortable enviroment resulted in Child #1 sustaining injuries while in care. Based on conflicting information, it is undetermined if a child's weight loss was due to inadequate food service.

Although the allegations may have happened or are valid, there is not a preponderance of the evidence that violations occurred; therefore, the above allegations are unsubstantiated. Per California Code of Regulations, Title 22, Division 12, Chapter 3, no deficiencies were cited on this report. An exit interview was conducted and report was reviewed with the licensee Margarita Madrigal. A copy of Appeal Rights and the Notice of Site Visit was given and must remain posted for 30 days.

On 4/14/2022, Licensing Program Analyst (LPA) Theresa Marquez provided complaint findings regarding the above allegations. LPA met with licensee Margarita Madrigal. Assistant Maria Rodriguez was also present.

During the course of the investigation, LPA conducted interviews with staff and parents. The investigation revealed licensee failed to follow parents instructions in treating Child #1 diaper rash. Licensee confined Child #1 hands to prevent the child from scratching at Child #1 infected ear.
Based on the information obtained during the investigation, there is a preponderance of the evidence to prove licensee failed to meet child's diapering needs and used inappropriate discipline method, therefore, the allegations are substantiated.
Per California Code of Regulation Title 22, Division 12, Chapter 1, the following deficiencies was cited (continued on LIC9099-D).
An exit interview was conducted and this report was reviewed with the Margarita Madrigal. A copy of Appeal Rights and the Notice of Site Visit was given and must remain posted for 30 days.

Child #1 is not longer enrolled at this day care home. Licensee is to submit a plan to licensing addressing how she will ensure the toileting needs of children in care are adequately met at all times. This plan is to be submitted to the Fresno Community Care Licensing Department by 4/29/2022.
