25 | On October 18, 2022 at 11:53 AM Licensing Program Analyst (LPA) Austin Rios conducted an unannounced Case Management inspection to follow-up on an Action Level Exceedance (ALE) reported to the Regional Office by Division of Drinking Water (DDW). LPA met with facility representative, Alan Hatmaker and advised him the purpose of the inspection. Facility representative and president of corporation provided LPA a tour of the facility inside and out. There were zero children in care at the time of the inspection. Facility is currently closed due to not having a director and has been closed since 9/2/2022 and are actively looking for a new director.
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five (5) years after the date of the first test. If the water testing results indicate that the facility has an ALE, an immediate response shall be required pursuant to section 101704, which may include remediation.
The Regional Office received an ALE for five (5) water outlets in this facility. The Center was notified by LPA Rios of the results. LPA advised facility representative that location A, B, C, D, and E had an ALE of above five. Outlet A results were 16, outlet B is 17, outlet C and D read at 11ppb and outlet E is 13 ppb. Facility representative labeled each outlet during the inspection and stated he would make each area inaccessible and off limits.
During today’s inspection, LPA toured the entire facility and inspected the outlets in question. All outlets are located in the classroom except one that is in the kitchen and that outlet has been replaced. The outlets were used for washing hands, and food preparation.
