25 | On 4/19/23, at 3:30 PM Licensing Program Analysts (LPAs) Elvin Baddley and Giovani Gonzalez conducted an unannounced Case Management inspection at the abovementioned Child Care Center (CCC) to follow-up on an Action Level Exceedance (ALE) reported to the Regional Office by Division of Drinking Water (DDW). LPAs met with CCC Director, Sarah Hutson, and advised of the purpose of the inspection. LPAs, in the company of Director, toured the interior and exterior of the CCC. LPAs observed 43 children in care at the time of the inspection.
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five (5) years after the date of the first test. If the water testing results indicate that the facility has an ALE, an immediate response shall be required pursuant to section 101704, which may include remediation.
On 11/22/22, the CCC was advised of ALE reported to the Regional Office by DOW. The facility was cited (Type B) pursuant to WD 101700.3. As a corrective action, the CCC removed all ALE related fixtures from service, placed plastic covering over the fixtures to preventing children/staff from being able to access the water sources for consumption or the washing of food items. Moreover, the CCC placed signs above the fixtures which read, " DO NOT USE." To ensure children are able to consume uncontaimented water, the CCC provides children in care filtered water both inside and outside the CCC. Children in care are also able to bring drinking water from home. The CCC retested the ALE related fixtures following the aforementioned.
The Regional Office received ALE for three water fixtures (water fountain "A"- 19.9 ppb, water fountain "A30"- 9.3 ppb, and water fountain "C"- 7.1 ppb). The CCC was notified by CCLD (LPA Daniel Venegas) of the results on by phone on 4/14/23. Director informed CCLD all fixtures retested continue to be removed from service, labeled with " DO NOT USE," and covered with plastic. Further, Director informed LPA children in care continue to have filtered water both inside and outside the CCC and also have the ability to bring water (CONT. LIC 809-C) |
