32 | to complete the changing of a child’s diaper, which included, having several staff attempting and contacting parents to come into the center to complete the diaper changing of a child if need be.
During interviews with staff, and parents informed LPA the staff will attempt to change the child’s diaper, if the child refuses to have their diaper changed, the staff will request another staff member attempted to complete the changing of the child’s diaper. If the child continues to refuse to allow staff in completing the diaper to be changed the center will contact the parents to come into the center and change the child’s diaper or wait until pick up time and advised the parent the child has a soiled diaper, due to after several attempts made by staff to change the child’s diaper the child refused to have their diaper changed. The staff would then offer parent to come into the center and change child’s diaper.
Based on LPAs observation, record reviews and interviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulation, (Title 22 Division 12 and 101223 (a)(1) and 101227 (a)(14), are being cited on the attached LIC 9099 D).
A closing interview was conducted with the Master Teacher, Euludia Lopez Lia. The Master Teacher was provided and advised of their right to appeal (LIC 9058). A copy of this report was reviewed and provided to the Master Teacher.
The Notice of Site Visit (LIC 9213) was also provided to the Site Supervisor by H&S Code Section 1596.817. The Notice of Site Visit must remain posted for 30 days or a civil penalty of $100.00 may apply.
