The center meets Title 22 Division 12 requirements for 46 toddlers and 164 preschool children. License will be effective today, 08/17/2023 for total capacity of 210 children.
During the tour, LPA found one staff member (S1) not listed on the facility roster. LPA asked S1 how long she has been working at the facility for, S1 stated she just started on Monday August 14, 2023. LPA asked if a criminal clearance notice had been received, S1 stated yes that the Director should have it. Upon record review it was determined that S1 did not have a criminal record clearance on file. LPA verified through the online background check system, Guardian, that the employee was not fingerprint cleared and no record of S1 was found. At 2:35 PM, LPA observed S1 leave the facility. LPA advised Director that S1 cannot return until fingerprint clearance has been granted.
Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
A copy of this report must be provided to the authorized representatives of all currently enrolled children and must also be provided to newly enrolled children for the next 12 months. The report shall be provided no later than the next business day or the next day the child is in care.
