On 03/04/2020, at 9:05 a.m. Licensing Program Analyst (LPA) Jill Laxo conducted an unannounced inspection for the purpose of concluding a complaint investigation into the above allegation. LPA met with Licensee Celia Ortiz and discussed the nature and purpose of the inspection. Licensee had two children in care.
The investigation included two unannounced inspections, licensee and complainant interviews, and record review. On 02/06/2020, LPA performed a record review of the October attendance sheets for children in care, which established that the licensee had operated beyond the limitations of her license. The licensee interview conducted on 02/07/2020, and complainant interview conducted on 02/06/2020, determined the Family Child Care Home was out of ratio during the month of October. The evidence gathered determined that during after school pick up and afternoon drop off the licensee and assistants cared for 15 to 16 children from 3:00 p.m. until 3:29 p.m.
Based on LPA’s observations, interviews and record review, the preponderance of evidence standard has
been met; therefore, the above allegation is found to be SUBSTANTIATED California Code of Regulations,
(Title 22, Division 12 & Chapter 1), are being cited on the attached 9099D.
An exit interview was conducted with licensee Celia Ortiz and Plans of Correction were developed. A copy of this report and appeal rights were discussed and provided to licensee whose signature on this form confirms receipt of these documents.

Licensee advised parents that the time for pick up and drop off for after school care would be adjusted so there would be no more than 14 children in care at one time. Parents were advised to fill out time sheets with the exact time that children are in care.

Based on record review and interviews the licensee did not adhere to the maximum capacity criteria for a large family child care home license, which poses a potential Health, Safety or Personal Rights risk to the children in care.
