13 | On 05/07/2021, at 11:45 a.m., Licensing Program Analyst (LPA) Jill Laxo conducted an unannounced inspection to conclude the complaint investigation on allegations received on 02/19/2021. Due to COVID-19 and Department of Public Health (DPH) guidelines of social distancing, a tele-inspection was conducted via FaceTime. The nature and purpose of the inspection was discussed with Director Rosa Valencia. There were 3 children and 3 teachers in the preschool program at the time of inspection.
The allegations claimed a staff member handled a day care child in a rough manner resulting in injury and staff used an inappropriate form of punishment for day care child. Investigation included email correspondence, incident reports, individual action plans, photograph and video review, interviewing complainant, director, staff members, and parents of both children previously and currently in care. Seven staff members were interviewed and stated the they had never witnessed a staff handling a child in a rough manner, nor any staff member using an inappropriate form of punishment. Staff stated the policy is to redirect children, not to use time out or punishment.
Parents interviewed stated they have never witnessed a staff member handle a child in a rough manner. The video, photograph and record review evidence does not support the allegations. Although these allegations may have occurred, there is not a preponderance of evidence to prove that the alleged violations did or did not occur, therefore, the allegations listed above are deemed UNSUBSTANTIATED.

Failure to maintain posting as required will result in a $100.00 civil penalty.
