On March 14, 2024, at 9:45 AM Licensing Program Analysts (LPAs) Laura Villanueva and Aaliyah Zendejas conducted an unannounced inspection to investigate and conclude investigation for the above allegations. LPAs met with Jaleh Mirzadeh and explained the purpose of the visit. LPAs conducted a tour of the facility inside and outside. LPAs observed a total of 4 children in care. Another infant arrived at a later time.

Upon entering the home, LPAs observed a staircase next tot he front door unbarriacded and accesible to child care children. LPAs asked licensee why the stairs did not have a barricade. Licensee responded that the other LPAs that inspected last time did not mention anything about the stairs needing to be barricaded. LPAs review previous LIC809 report dated 12/28/2021. During that visit there were no children present, so a citation was not issued. The allegation , "Licensee did not ensure stairs were barricaded." was observed. LPAs observed chemicals such as round up weed killer , insect spray on a shelf next ot the staircase. LPAs abserved Glade spray on a low shelf in the children's restroom. LPAs observed kitchen knives on the kitchen counter accessible to children. LPAs informed licensee that kitchen knives need to be stored at least 5 feet

high or locked to make them inaccessible to children. Licensee stated that she uses a gate to keep children in the child care area. LPAs observed gate to be open. The allegation, "Licensee did not provide a safe environment for day-care children" was substantiated by LPAs observations.

While LPAs were touring the 2 story home, licensee informed LPAs that 2 infant were sleeping upstairs. LPAs and licensee went upstairs with licensee. On top of the stairs, licensee removed a dog pad with urine out of the path. Licensee opened a bedroom on the right side of the hallway. C1 was sleeping on her stomach with a pacifier attached to her shirt in her mouth. LPAs asked where the other infant was sleeping. Licensee led LPAs to a bedroom on the opposite side of the hallway .Licensee opened the door. LPAs observed an infant in a playpen on a pillow and an activity hanging over playpen. Title 22 Division 12, Chapter 1, Article 06 Continuing Requirements 102425 Infant Safe Sleep prohibit the manner in which infants were observed to be sleeping. Licensee stated that she was not informed of the infant safe sleep regulations. LPAs gave licensee a copy of the regulations for her reference. LPAs informed licensee that it is her responsibility to abide by Title 22 regulations at all times. The allegation, " Licensee left day-care child(ren) unattended" and "Day-care children are being neglected while in care" was observed when infants were on the second floor with the door closed. Infants could not be visually observed out moving the door and the licensee needs to be on the same floor as the sleeping infant. Licensee does not have LIC9227 Individual Infant Sleeping Plan or 15 minute sleep logs for infants in care.

Based on LPAs observation, interviews conducted documentation and photos obtained, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED.

A copy of this report must be provided to the authorized representatives of all currently enrolled children and must also be provided to newly enrolled children for the next 12 months. The report shall be provided no later than the next business day or the next day the child is in care.

Copies of this report must be posted for 30 days in a visible location for the authorized representatives of children. Notice of Site Visit has been posted (LIC9213). The notice shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
