On September 20, 2023 Licensing Program Analyst (LPA) conducted an unannounced case management- deficiencies inspection. LPA met with director Viktoriia Shevkunova and advised her the purpose for the inspection. Together with the director LPA toured the facility, at the time of inspection there were 31 children in the care of 8 staff.

While conducting staff file reviews, LPA found that one staff member (S1) was not on the facility roster. LPA asked director if S1 had obtained a criminal record clearance. Director stated yes and showed LPA a printout of S1's Guardian profile. LPA asked director if she received a criminal record clearance letter indicating that S1 was clear and eligible to work at her facility. Director stated no and said, "I assume the profile page was enough".

LPA contacted the Community Care Licensing office to inquire about possible clearance for S1. It was found that S1 was previously associated to an adult care facility and separated in 2018. No current applications or associations were observed to be on record. LPA asked how long this staff member has been working on site, director stated S1 was hired in mid August. LPA advised Director that S1 did not have a criminal record clearance to be working on site.

Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA Martinez informed Director Viktoriia Shevkunova that this report dated 09/20/2023 documents One Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Martinez informed the Director Viktoriia Shevkunova to provide a copy of this licensing report dated 09/20/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

One deficiency was cited today and can be seen on the attached 809-D.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted, appeal rights were given, and report was reviewed with director Viktoriia Shevkunova.
