32 | On 3/22/22, Complaint Allegation was also cross reported to the Children's Residential Program. According to statements made by the Children's Residential LPA, Karen McGee she stated that she interviewed all 4 children which are under her guardianship. All 4 children denied physical abuse at the hands of the provider.
During LPA Cervantes and LPA McGee's respective visits on 3/24/22 and 3/20/22, LPAs toured the licensee's kitchen and observed that the kitchen cabinets were locked. The cabinet under the sink is also locked and LPA McGee had licensee open the cabinet stated that there "is not room to put a child under the sink. That is where she stores the chemicals." The surrounding cabinets also do not have any room to fit a child given that there are multiple shelves. The information and evidence obtained during the investigation did not sufficiently support the allegation.
This agency has investigated the complaint(s) alleging "Licensee puts daycare children under the sink while in care." Based on the evidence obtained during the course of the investigation, the Department has determined that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.
A notice of site visit was given and must remain posted for 30 days.
