Licensing Program Analyst (LPA) Lauren Scott and Jennie Tedlos met with Director, Cathlean Ripley to deliver the findings of the complaint investigation regarding the above allegations.

During the course of the investigation, LPA Scott conducted interviews, and obtained information pertaining to the allegations. It was alleged that staff have been yelling at children in care as well as not providing adequate supervision due to cell phone usage.

Based on the interviews, it was revealed that staff have yelled at children when trying to enforce children to follow rules. It was also revealed that cell phones are being used by staff for personal, and/ or work use, and preventing staff from providing 100% supervision to children in case. Therefore, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Title 22 regulations are being cited on the attached 9099-D page.

LPA Scott informed director, Cathlean Ripley that this report dated July 26, 2023 documents two Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Scott informed the director to provide a copy of this licensing report dated July 26, 2023 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

On 07/26/23 LPA Scott and LPA Jennie Tedlos conducted a complaint investigation. It was alleged that staff handled a child in a rough manner.

During the course of the investigation, LPA Scott conducted interviews, and obtained information pertaining to allegation. Staff discussed methods used to protect children and keep them safe, including redirection. Although the staff may guide a child or help them in a potentially dangerous situation, it didn't appear to be in a rough or harmful manner.

Based on the interviews, the information obtained appeared to be conflicting. LPA Scott determined that the complaint was found to be UNSUBSTANTIATED, meaning although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.
Exit interview was conducted. A notice of site visit was provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
