Licensing Program Analyst (LPA) Chayntel Hunter met with Director, Rosario Iniguez to deliver the findings of the complaint investigation regarding the above allegation. During the course of the investigation, LPA Hunter conducted interviews, and obtained information pertaining to allegation. It was alleged that staff are commingling children. Interviews conducted revealed that older children from the infant side and smaller children from the preschool side are commingled to prevent injuries from older children. LPA discussed regulations and advised facility to obtain a toddler component so that the facility would be in compliance.

Based on the interviews and review of records the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. The following Title 22 Deficiency is being cited on the subsequent 9099-D pages. Upon receipt of Type A citations, Director shall post and provide copies of the LIC 9099-D for parents/guardians of children in care and for parents/guardians of newly enrolled children for the next 12 months. Licensee must also keep the signed LIC 9224, acknowledging receipt of LIC 9099-D in each child's file. Appeal Rights and Notice of Site Visit were provided.

Licensing Program Analyst (LPA) Chayntel Hunter met with Director, Rosario Iniguez to deliver the findings of the complaint investigation regarding the above allegations. During the course of the investigation, LPA Hunter conducted interviews, and obtained information pertaining to allegations. It was alleged that infants were not fed properly. Interviews conducted revealed that the facility was using objects to prop infant bottles, but had corrected the issue, since receiving a prior citation. Interviews did not corroborate that staff were still improperly feeding infants. It was also alleged that there was an outbreak at the facility that was not reported to Licensing. Based on interviews conducted it was determined that there was not an outbreak that required reporting.

Based on the information obtained throughout the course of this investigation the above allegations could not be substantiated or dismissed. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the finding is UNSUBSTANTIATED. Exit interview was conducted. Notice of Site Visit was provided.

Director will discuss obtaining a toddler component option to remain in compliance. If a toddler component is not obtained the Director will make a plan to keep children separated. LPA Hunter provided facility with a checklist to obtain a Toddler Component.

Based on interviews conducted it was revealed that older children from the infant side are commingled with younger children from the preschool side. This is an immediate health and safety risk to children in care.
