A follow-up unannounced complaint visit was made to the facility by Licensing Program Analyst (LPA) Emilia Grisak. LPA met with Center Director Yolanda Padilla. This agency investigated a complaint alleging that lack of supervision resulted in child sustaining an injury while in care, specifically that C1 was observed to have a quarter-sized red mark above eye that faded within 20 minutes that staff could not explain.
Unannounced complaint visits were conducted on 1/24/20 and 2/19/20. The Center Director was interviewed on 1/24/20 and denied the allegation. The Center Director stated that there were no injuries to children that have occurred that she could think of. During the investigation, interviews with staff and parents were conducted on 1/24/20, 2/11/20, and 2/18/20. It was stated in staff interviews that there have been no recent injuries to children. It was stated in staff interviews that C1 was crying and the child’s skin looked red and blotchy, but it was not the result of an injury. It was stated in parent interviews that children have not had unexplained injuries while in care. LPA toured the facility on 1/24/20 and 2/19/20 and observed that children were being appropriately supervised, and the facility is operating in ratio. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

It was also alleged that staff failed to provide comfortable accommodations to children in care, specifically that C1 was observed outside on the playground not wearing socks and shoes. Unannounced complaint visits were conducted on 1/24/20 and 2/19/20. The Center Director was interviewed on 1/24/20 and denied the allegation. The Center Director stated that when children go outside, they are supposed to have shoes on. She stated that children will sometimes remove their own shoes and staff will put them back on. During the investigation, interviews with staff, parents, and witnesses were conducted on 1/22/20, 1/24/20, 2/11/20, and 2/18/20. It was stated in staff interviews that children wear shoes when they are outside. It was stated in staff interviews that some children, including C1, frequently remove their own socks and/or shoes and staff put them back on. It was stated in parent interviews that children have not been observed playing outside without shoes on. It was stated in a witness interview that C1 was observed outside without socks and shoes and a staff was observed nearby holding C1’s socks and shoes. It was stated by the witness that it is possible staff were trying to put C1’s socks and shoes back on. LPA toured the facility on 1/24/20 and 2/19/20 and observed that children were appropriately clothed and wearing shoes. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
