On 6/22/2022 at 10:30an Licensing Program Analyst (LPA) Kirk Marks conducted a subsequent complaint investigation inspection to the family child care home for the purpose of delivering complaint findings. It was alleged that child was forced to lay down quietly on nap pad for entire nap period. It was also alleged that parents are not allowed to pick up children during the nap time and will not be allowed into the family child care home during that time. LPA met with licensee, Laurel Martinez, on 3/22/2022 and discussed the allegations. Licensee stated that children are required to take naps or lay down quietly for the nap time that licensee has designated. Licensee said that all children in care take nap time from 12:30pm to 3:00pm every day. Licensee also said that she doesn’t allow parents to pick up children during that time because it interferes with children during the nap time. LPA requested and received a copy of the admission agreement that is provided by licensee for parents on 3/22/2022.

The agreement states that parents are not allowed to drop off or pick up children during nap time between 12:30pm and 3:00pm and that licensee will not open the door for parents if they come to the home during this time. The agreement also states that children are highly encouraged to stay on beds during the duration of nap time and that the caregiver may terminate care if any napping issue cannot be solved. LPA conducted telephone interviews with three parents (P1, P2, and P3) Two of the three parents interviewed expressed concerns about the nap time and felt they would have to look into finding another provider as their children were finding it difficult to nap or lay down quietly for the entire nap time. Based on the statements by licensee and record review, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
Appeal rights were provided and exit interview was conducted.
The notice of site visit must be posted for 30 days.

On 6/22/2022 at 10:30an Licensing Program Analyst (LPA) Kirk Marks conducted a subsequent complaint investigation inspection to the family child care home for the purpose of delivering complaint findings. It was alleged that child (C1) was held down by the child’s ankles during nap time in order to keep the child down until nap time was over for all the children. LPA met with licensee, Laurel Martinez, on 3/22/2022 and discussed the allegation. Licensee denied that the allegation happened. LPA also conducted an interview with the facility assistant who also denied the allegation occurred. LPA was not able to conduct an interview with C1 as phone calls were not returned to LPA for an interview. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.
Appeal rights were provided and exit interview was conducted.
The notice of site visit must be posted for 30 days.
