On 7/23/2026 at 8:15AM, Licensing Program Analyst (LPA) Paulita De La Cruz met with center director Ms. Mirsha Heredia Gomez, for an unannounced visit to deliver the findings on the above allegation. Forty-eight (48) children and twelve (12) staff were present during this visit. An allegation was made that staff did not prevent day care child from pulling another child's hair. Based on interviews conducted during the course of this investigation, the preponderance of evidence has been met. The above allegation was found to be SUBSTANTIATED.

A Type B deficiency citing Title 22, Section 101212(d)(1)(C) was issued during today's visit on LIC 9099-D following this page.

An exit interview was conducted with center director, Ms. Gomez. This report and Appeal Rights were provided. The Notice of Site Visit form was also provided and must be posted for 30 consecutive days.

Reporting Requirements: (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event.
(1) Events reported shall include the following:
(C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.

The center shall conduct an all staff training on reporting requirements to ensure non-recurrence of incident(s) of the same or similar in nature. A plan and agenda must be sent to LPA De La Cruz no later than August 7, 2026. Proof of staff attendance must also be sent to LPA within 1 week of concluding the training. Plan/agenda and proof of attendance must be sent via email to LPA at paulita.delacruz@dss.ca.gov.

This regulation was not met as evidenced by: Staff interviews and record reviews conducted during the course of the investigation, it was determined that the center failed to report an incident that occurred sometime in December 2025.

Forty-eight (48) children and twelve (12) staff were present today. An allegation was made that staff did not prevent day care child from pulling out another child's hair. Based on interviews conducted during the course of this investigation, LPA received conflicting information. The above allegation is UNSUBSTANTIATED which means although the allegation may have happened or is valid, the preponderance of evidence to prove the alleged violation did or did not occur has not been met.

There was no citation issued for the above allegation.

An exit interview was conducted with center director, Ms. Gomez. This report and Appeal Rights were provided. The Notice of Site Visit form was also provided and must be posted for 30 consecutive days.
