13 | LPA Diana Campos met with Area Manager Monica Williams for a complaint investigation regarding the above allegation. Present during the investigation were 8 staff and 16 preschool children in care. It was alleged that a child has been bullied by children in care. During the course of the investigation, interviews were conducted. Per interviews conducted, a child has been hit by 3 different classmates while in care, both during outdoor and indoor playtime. Interviews also revealed that the incidents have happened between the child and her friends where both children have hit each other. Per interviews, some of the children involved are special needs children who's behavior could not be predicted or prevented fast enough by staff present. During the investigation, children's personal rights were discussed. LPA could not determine if the incident's were the result of being bullied by classmates or special needs children who could not control an impulse to strike during playtime or struck with intent to bully. Based on the investigative findings, there was no evidence to determine whether or not a child has been bullied by children. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur. Therefore, the allegation is unsubstantiated.
