13 | LPA Lisa Dyer met with facility director Linda Sahgal for a complaint investigation regarding the above allegation. Present: director, 8 staff, and 46 preschool children. Complainant states that Staff did not provide proper supervision to child in care. Interviews disclosed that a child in care was difficult to supervise. The child would throw pencils, hit classmates and staff, climb on activity shelves, and kick open/jump over gates that kept children inside the classroom. During the day in question, the child kicked and maneuvered past a gate. The child ran into a second classroom. Staff member immediately ran after the child, but the child went into a classroom where construction work was taking place. There were power tools in the classroom. Because the child was able to leave the classroom unsupervised and enter a classroom with hazardous materials, this allegation will be Substantiated. Based on the LPA's observations and interviews which were conducted, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations (Title 22, Division 12), are being cited on the attached LIC 9099D and must be corrected by the due date. Exit interview conducted. Appeal rights were discussed and given. Notice of Site visit must be posted for 30 days. |
