This is an amended report for the report dated March 16, 2023
On March 16, 2023 Licensing Program Analyst (LPA) Indira Loza met with Director Chen Chien-Hsuan to continue a complaint investigation. LPA toured the classrooms for a health and safety check. There were 76 children in care and 10 staff.

LPA conducted staff and children interviews and reviewed center documents. The allegations are that the facility is in disrepair and did not maintain a comfortable temperature for the children. The central heating system in the building was disabled due to flooding, and the classrooms had to be supplied with space heaters. The windows were also cracked open to maintain ventilation as a COVID precaution which made the classrooms' temperature drop below 68 degrees and children had to wear jackets inside the classrooms to combat the cold. Based on LPAs observations and interviews, the preponderance of evidence standard has been me and the above allegations are found to be substantiated.
An exit interview was conducted, appeal rights were given, and a copy of this report was provided to Director Chen Chien-Hsuan.

Facility shall ensure that all the classrooms are at least 68 degrees and send the LPA an image of a thermostat in each classroom displaying a temperature of at least 68 degrees F no later than March 31, 2023.

The building did not have any heat in the classrooms for approximately two weeks where the temperatures reached below 68 degrees F. This poses a potential health and safety risk to the children in care.

Director shall review the regulation and watch the video titled "Children's Personal Rights in Child Care" which can be found on the CDSS website. Director shall also email the LPA a statement as to why the facility maintenence is important for the Personal Rights of children, no later than March 31, 2023.

This requirement was met as evidenced by: Based interviews and record review it was determined that the children were cold while inside the classrooms and had to wear jackets while indoors. This poses a potential health and safety risk to the children in care.
