Licensing Program Analyst (LPA) Jyoti Saini arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with director Gabriela Arrizon and explained the purpose of the inspection. Present for today's visit, there were director, and 18 staff members supervising 145 children.
Based on interviews with staff and children, the information gathered indicated that no one had witnessed teachers in question handling a child in a rough manner. The interviews with the children did not reveal any supportive evidence of such conduct. The facility is equipped with CCTV cameras; however, due to the system’s retention policy, the footage could not be retrieved. According to the facility’s agreement, the system’s hard drive retains footage for up to seven calendar days. Therefore, Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is deemed UNSUBSTANTIATED.
Notice of site visit was provided and must be posted for 30 days.
Appeal rights were given, and an exit interview was conducted with director Gabriela Arrizon.

LPA met with director Gabriela Arrizon and explained the purpose of the inspection. Present for today's visit, there were director, and 18 staff members supervising 145 children.
Based on interviews with staff and children, the information gathered indicated that no one had witnessed the teachers in question speaking to the children inappropriately. The interviews with the children did not reveal any supportive evidence of such conduct. The facility is equipped with CCTV cameras; however, due to the system’s retention policy, the footage could not be retrieved. Licensing Program Analyst (LPA) Jyoti Saini arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with director Gabriela Arrizon and explained the purpose of the inspection. Present for today's visit, there was director, and 18 staff members supervising 145 children.
Based on interviews and record review, the facility acknowledged that an incident occurred in which Child 1 (C1) sustained an injury. Information gathered revealed that staff were supervising children in the playground however, no staff observed the moment the injury occurred. Staff became aware of the injury only after the child approached or was brought to them. Although the injury did not require immediate medical attention and parents were notified the same day, the lack of direct observation indicates that supervision was not maintained at all times, as required by Title 22.The preponderance of evidence standard has been met; therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101229(a)(1) is being cited on the attached LIC 9099D.

101229 Responsibility for Providing Care and Supervision
(a) The licensee shall provide care and supervision as necessary to meet the children's needs.
(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.

The facility shall submit a written plan to the Community Care Licensing Division (CCLD) outlining how staff will consistently ensure visual supervision of all children in care. All staff shall undergo mandatory training on Title 22 supervision requirements, with emphasis on always maintaining direct visual supervision. The facility shall obtain staff signatures to confirm their understanding of the training. Additionally, all staff will be required to view the "Supervising Children in Child Care Centers" video available at ccld.childcarevideos.org and submit a written statement summarizing their understanding of proper supervision practices. These statements will be collected and submitted to CCLD by the Plan of Correction (POC) date.
