On 9/23/2025 at 10:30 am, the Licensing Program Analyst (LPA) Manel Estoesta conducted a Complaint Investigation. LPA met with the Director Latashia Ware and explained the nature of the visit. Present on this facility were 18 Staff member, 10 toddlers and 78 preschool children.

The facility operates from Monday to Friday, 7 am to 6 pm.

The reporting party (RP) alleged that of the above allegation.

LPA conducted interviews. LPA also obtained copies of facility records and conducted record reviews.

Based on the LPA’s interviews and record reviews, that on 9/16/2025, Director Ware reported to the Child Care Oakland Regional Office via the telephone, an unusual incident happened.

The incident happened on 9/15/2025 at 4:45 pm, S1 notified the front desk staff that C1 was not present in the classroom. Director Ware went to the outdoor play area and found C1 inside a play structure, unsupervised. C1 was left behind, at the outdoor play, when C1 class transitioned back from an outdoor activity to C1’s classroom.

LPA concluded that on 9/15/2025 that C1 was unsupervised, approximately, from 4:30 pm to 4:45 pm.

The Licensee were in violation of Section 101229 (a)(1) that no child(ren) shall be left without the supervision, including visual supervision, of a teacher at any time….

The preponderance of evidence standard has been met; therefore, the above allegation is to be SUBSTANTIATED.

LPA Estoesta informed the Director that this report dated 9/23/2025 included a Type A Citation which shall be posted for 30 consecutive days as there is an immediate and potential risk to the health, safety, and or personal rights of children in care.

Also, the LPA informed Director Ware to provide a copy of this licensing report dated 9/23/2025 that documents of any Type A citation, to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

LPA advised Director to develop a plan of correction and submit proof to the Oakland Office via email or mail on or before the POC due date. The Plan shall describe how the licensee will bring their facility into compliance. It must be measurable and verifiable.
During the visit, Director Ware provided copies to LPA, of the facility's POC documentation, which included Transition Policy and Procedure, Supervision and Transition Audit, and a future dated Staff Meeting Agenda on 9/24/2025.

LPA recommendations and requirements are the following,

1. The Technical Support Program (TSP). TSP is FREE, voluntary, and a non-enforcement service of Community Care Licensing to assist child care providers experiencing compliance challenges.

2. Today's reports will be endorsed to the local Resource and Referral for review.

3. Submit a copy, 9/24/2025 staff minutes of meeting to LPA.

4. Licensee to continue reaching out for resources to local Resource and Referral via Mychildcare.org.
