32 | On 2/28/24 LPA E. Laird interviewed two staff at the facility (S1, S2). S1 stated on 2/27/24 (C1) was playing outside and was bit by a spider. S1 stated they heard C1 crying and holding out their finger. S1 went over to C1 and noticed an insect, which appeared to be a black widow, on C1's finger. S1 "flicked" the spider off and took C1 over to S2 and some other staff. S2 stated they took C1 into the classroom and cleaned the bite and put ice on it. S2 stated they attempted to contact parents and eventually called 911. S2 stated C1 was assessed by the paramedics but did not leave in the ambulance. S1 and S2 stated staff do not inspect the play yard prior to going outside. S1 stated if they see insects, they will kill them with bug spray, their shoe or a stick. S1 stated staff know there are insects outside and they look for them when they go outside with the kids. S1 stated the spiders usually start coming out when the weather gets warmer. S1 stated the children know not to touch the bugs and to get a teacher if they see one.
LPA E. Laird obtained a receipt dated 2/22/24 @ 5:30pm for a pest control visit. The receipt indicates the facility was sprayed for ants, spiders, roaches, earwigs, wasps, and black widow spiders.
LPA E. Laird inspected the play yard at 11:58am. LPA E. Laird inspected all play equipment and fence line. LPA E. Laird did not observe any insects or spider webs. LPA E. Laird took three photos of play equipment.
Although the facility acknowledges there is an issue with insects on the play yard, and a pest company came to spray for insects on 2/22/24, it could not be determined a child was bit by an insect due to staff not ensuring the facility was free of insects.
Therefore, Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
