On 7/16/24 at 9:46am, Licensing Program Analyst (LPA) Bianca Mendez and Tammy Dutra conducted an unannounced complaint inspection and met with licensee Nikki Ray. It was alleged that Staff are operating over ratio and unqualified staff are providing care & supervision to children.
The licensee was interviewed on 5/28/24 at 7:55am and denied the allegation and stated that they have 3 main teachers in the classroom, and they always have 12 kids until another teacher comes in from the toddler room. Licensee stated that unqualified staff are not left alone and are supervised by someone who has the units and are teacher qualified.

LPA interviewed staff (S1-S6) on 5/28/24 and 6 of 6 staff stated that staff are not operating out of ratio and have infant teachers qualified in the classroom. 6 of staff stated there are no unqualified staff providing care & supervision to children. 2 of 6 staff stated they do not have infant units to be left alone with infants and are not left alone supervising infants.

LPA interviewed parents (P1-P3) and 3 of 3 parents stated no staff are not operating out of ratio. 3 of 3 parents stated they were not aware if staff are qualified to watch infants.

On 5/28/24 LPA reviewed infant staff transcripts and determined based on file reviews that 2 of 3 staff in the infant classroom does not have the infant units to be left alone supervising infants. The transcripts reviewed indicate that one staff member does not have any ECE units, while there is only one qualified infant teacher who meets the necessary qualifications to supervise the infants. Therefore, the current staffing situation does not meet the required ratio and qualifications for proper infant supervision.

During today’s inspection, the facility was toured. LPA observed 3 staff and 8 infants in care.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
