On 8/7/24/24 at 12:05pm, Licensing Program Analyst (LPA) Elizabeth Friese conducted an unannounced complaint inspection and met with Site Supervisor Brisa Martinez for the purpose of delivering complaint findings. It was alleged that staff did not provide adequate supervision to children in care, specifically that a child (C1) touched another (C2) inappropriately as a result, and that unqualified staff had been left alone with children. The site supervisor and 4 staff were supervising 26 children and operating within capacity/ratio requirements.

The owner Thamalka Mudannayake was interviewed on 6/18/24 at 9:04am and had no knowledge of the allegation. She stated that there was a recent incident of one child accusing another of touching them inappropriately, but they then said that they made it all up and their parent apologized. Staff has been directed to keep eyes on children when they use the restroom, and to her knowledge unqualified staff is never left alone to supervise children as they don't have the appropriate education. Owner Mudannayake stated that she has recently purchased the facility and is trying to improve it, but the transition has been more difficult than anticipated.

On 7/11/24 between 11:22am and 2:35pm, 5 staff (S1-S5) and 3 parents (P1-P3) were interviewed regarding this allegation. 3 staff reported having no knowledge of any incidents of children touching one another inappropriately, and 2 had heard of an instance of a child having made up a story and then rescinding, which their parent then apologized for. S1 stated that there is regular training and discussion among staff about supervision and ratio. The unqualified staff (S4) that was interviewed indicated that they are not utilized as teaching staff at any time and are not allowed to supervise children per the new owner.
P1-P3 reported having no concerns regarding supervision/unqualified supervision; P2 recalled seeing an unqualified staff member directing a child who was trying to come inside back to their teacher outdoors.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, and therefore the findings are unsubstantiated.
