On 6/25/24 @ 8:12am, Licensing Program Analyst (LPA) Erica Laird conducted an unannounced complaint inspection and met with facility director, Anoma Thilakeratne. It was alleged staff did not pick daycare child up from school.

On 6/25/24 LPA Laird conducted an interview at the faciltiy with director Anoma Thilakeratne. Anoma confirmed the allegation that staff did not pick up a child from school. Anoma stated she was aware children had been left behind at the school. Anoma stated they are addressing this issue and will be implementing new procedures to ensure children are not left behind at the school.

During today's inspection, the facility was toured and three children interviews were conducted.

On 6/25/24 Licensing Program Analyst (LPA) Erica Laird conducted three children interviews (C1, C2, C3). All children interviewed acknowledged children had been left behind at school during pick up. Two children stated they had been left behind at the school on several occasions. One child stated they had not been left behind at the school but they had friends that had been left behind.

On 6/4/24 LPA Laird conducted interviews with two witnesses (W1, W2). Both witnesses stated they had observed children being left behind at school during pick up. Both witnesses stated they walked children over to the daycare and informed staff that the children had been left behind. One witness stated children are regularly left behind at the school and have to be walked over to the facility by another adult.

On 6/7/24 LPA Laird conducted an interview with one parent (P1). P1 stated they had not heard of children being left behind at the school. P1 stated they did not remember the pick up procedures and did not recall if the facility had discussed the pick up procedures during enrollment.

On 4/22/24 LPA Laird conducted an interview with one staff (S1). S1 confirmed the allegation was true. S1 stated there are times children stay behind to complete projects or to talk to their teachers. S1 stated if children are not at the pick-up spot by a certain time, they are left behind. S1 stated staff do not check with the school office or parents to confirm children were absent.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D and a civil penalty has been assessed.

LPA Erica Laird informed facility director Anoma Thilakeratne that this report dated 6/25/24 documents one Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Erica Laird informed the facility director to provide a copy of this licensing report dated 6/25/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the facility director Anoma Thilakeratne. Appeal rights were provided.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
