Licensing Program Analyst (LPA) Cherie Acosta and Kareeca Sykes conducted an unannounced Plan of Correction visit. LPAs met with licensee Danielle Wright.

On 9/5/24 a complaint visit was conducted. Licensee was cited under the following:

- California Code of Regulation, title 22 102416.5(a) Staffing Ratio and Capacity

When LPAs arrived today, LPAs observed two children being picked up from care. Licensee was arriving at the home the same time as LPAs. Licensee arrived with a school aged child which made the total children present 8. Prior to LPAs and licensee arrival there were 9 children in care. Today, 9/16/24, licensee was operating beyond the capacity of the license.

A civil penalty of $1,000 is assessed today for failure to clear the citation issued on 9/5/24 for Staffing Ratio and Capacity.

On 9/5/24 a case management visit was conducted. Licensee was cited under the following:

- Health and safety code 1596.841 Facility Roster
- California Code of Regulation, title 22 102425(1) Infant Safe Sleep
- California Code of Regulation, title 22102370(d)(1) Criminal Record Clearance

Licensee provided an updated copy of the facility roster. Licensee's two assistants, Naiomi Simpson and Antanishia Simpson, now have criminal record clearance.

The following citations are cleared today:

- Health and safety code 1596.841 Facility Roster
- California Code of Regulation, title 22 102370(d)(1) Criminal Record Clearance

When LPAs arrived today, an infant was observed in the swing. As LPAs were entering the home the infant was taken out of the swing and put on the couch. As LPAs were touring the facility this infant was observed sleeping sitting up on the couch. There was no sleeping area set up for this infant.

A civil penalty of $1,000 is assessed today for failure to clear the citation issued on 9/5/24 for Infant safe sleep.

During the visit LPAs inspected the pool area. The pool was not properly fenced for the safety of children in care. LPAs observed gaps between the mesh pool fence and the wooden backyard fence. The gap is large enough for children to fit through. The pool gate is not self latching. The backyard deck is multilevel which makes a section of the mesh fence less than five feet high.

An immediate $500 civil penalty is assessed today for this violation.

The attached type A violation is cited today and must be corrected by the due date. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. All parents/guardians must sign an acknowledgement form of proof of receiving this report (LIC9224). The LIC 9224 must be placed in the child's file to be reviewed by licensing.

As a result of the pool not being in compliance, licensee has completed form Request for Inactive Child Care License Status LIC 9211
Exit interview and report reviewed with Danielle Wright.
Notice of Site Visit was provided and must be posted for 30 days.

fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence.This requirement was not as evidenced by:LPAs observed gaps between the mesh pool fence and the wooden backyard fence.The gap is large enough for children to fit through which is an immediate risk to the health and safty of children in care.

• This is a zero tolerance violation. An immediate $500 is assessed today and $100 per day will be assessed until corrected. Subsequent zero tolerance violations are $1000 immediate civil penalty and $100 per day will be assessed until corrected.
