Centralized Application Bureau (CAB) Licensing Program Analyst (LPA) Alecia Sifuentes and Licensing Program Analyst (LPA) Julia Placencia met with Applicant Piyoosh Jalan for the purpose of a prelicensing inspection. Applicants request an infant component for 41 infants ages 0-24 months, a toddler component for 45 toddlers ages 18-36 months, a preschool component for 134 preschool children ages 2-5 years, and a school-age component for 28 school-age children ages K-12 years for a total capacity of 248. The program will operate Monday through Friday from 7:00 a.m. to 6:00 p.m. The facility will be providing breakfast, lunch, and snacks. Parents will provide formula, breast milk, and baby food for their children.

LPA reviewed with applicant the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

INDOOR ACTIVITY SPACE:
There are three infant classrooms located in Rooms 1, 2, & 14, three toddler classrooms located in Rooms 3, 4, & 5, six preschool classrooms located in Rooms 6, 7, 9, 10, 11, & 13, and one school-age classroom located in Room 12. LPA observed a sufficient amount of equipment, toys, tables, chairs, high chairs, cubbies, and napping cots. LPA observed 20 cribs located in the crib areas which is separated from the activity space using a four-foot tall plexi-glass wall partition in infant Rooms 1 & 2. LPA observed no crib area in infant Room 14. Applicant stated that Room 14 will be for infants ages 12-24 months only and has requested a Sleeping Area for Infants waiver. There is a first aid kit located in the office. Medications will be stored in the office. LPA observed cleaning disinfectants are appropriately stored and inaccessible to children. Applicant stated there are no poisons or firearms on the premises. Applicant stated there will be a water pitcher and cups available in the classroom. LPA observed a functional carbon monoxide detector in the laundry room and office. LPA observed an electronic sign-in/sign-out system.

LPA measured the infant classrooms. The total classroom space contains a total of 1,446 square feet, which will accommodate applicant's request for 41 infants. LPA observed six sinks and one toilet for the infants within arm’s reach of a changing table. LPA measured the toddler classrooms. The total classroom space contains a total of 1,578 square feet, which will accommodate applicant’s request for 45 toddlers. LPA observed four sinks and seven toilets for the toddlers. LPA measured the preschool classrooms. The total classroom space contains a total of 4,690 square feet, which will accommodate applicant’s request for 134 preschool children. LPA observed fifteen sinks and twelve toilets for the preschool children. LPA measured the school-age classroom. The total classroom space contains a total of 988 square feet, which will accommodate applicants’ request for 28 school-age children. LPA observed two sinks and two toilets for the school-age children. There is a separate private restroom for the staff located in the hallway. Individual measurements are recorded on the Capacity Worksheet (LIC 9024). Children who become ill during the day will be isolated in the office and will use the staff restroom, if necessary.

OUTDOOR ACTIVITY SPACE:
There are three outdoor areas on the property, Infant Playground, Toddler Playground, and Preschool/School-age Playground. The outdoor play areas are fenced with a wrought iron fence that is at least four feet tall. LPA observed an additional chain link fence gate separating the components. There is a play structure located on the preschool/school-age yard which includes a safety label, which designates use for children 2 to 12 years. There is a swing located on the toddler yard which includes a safety label, which designated use for children 2 to 12 years. Applicant understand that children under the age of two years cannot utilize the swings at any time. LPA observed a sufficient amount of equipment and toys. There are no bodies of water on the premises. There are shaded areas supplied by three canopies.

LPA measured the infant outdoor activity space. The outdoor play area contains a total of 763 square feet, which will only accommodate 10 infants. Applicant has requested a Shared & Insufficient Outdoor Space Waiver for the infants to utilize the toddler playground at different designated times. LPA measured the toddler outdoor activity space. The outdoor play area contains a total of 3,672 square feet, which will accommodate applicants’ request for 45 toddlers. LPA measured the preschool/school-age outdoor activity space. The outdoor play area contains a total of 4,434 square feet, which will only accommodate 59 children. Applicant has requested a Shared & Insufficient Outdoor Space Waiver for the school-age children to utilize the preschool playground at different designated times and for the preschool children to conduct three outdoor rotations. Individual measurements are recorded on the Capacity Worksheet (LIC 9024).

LPA discussed the following: 100% supervision is required at all times; personal rights; inspection authority; reporting requirements; staff to children ratios and capacity; staff qualifications; and maintaining buildings and grounds. LPA discussed with Applicant any changes that may occur regarding the director or an employee acting in the director's absence must be reported to department within 10 working days.

Applicant was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Written Directives for Lead Testing in Child Care Centers: Assembly Bill 2370, Chapter 676, Statutes of 2018, added Health and Safety Code section 1597.16 requiring all licensed Child Care Centers constructed before January 1, 2010, test their water for lead between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first lead testing. For a license issued on or after July 1, 2022, initial testing results shall be received and posted within 180 days of licensure.
