Licensing Program Analyst (LPA) Soleil Marx, met with Director, Shannon Roberts, for the purpose of conducting an unannounced complaint investigation inspection alleging that children are fed food which they are allergic to. Throughout the course of the investigation, LPA made observations, conducted interviews, and reviewed records. It was determined by record review of child's file, posted allergy list, and staff interviews, that a child in care with a documented nut allergy was served peanut butter. The peanut butter was removed immediately by staff when they realized their mistake, however the child had already taken a bite of the restricted food. The facility notified authorized representatives immediately. The child did not have an allergic reaction nor did the child need medical attention, however the facility failed to adhere to the child's dietary restrictions. Based on LPAs record review and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. A title 22 deficiency was cited on the subsequent page of this report. Exit interview conducted,report reviewed with Director, appeal rights provided. Notice of site visit given and must remain posted for 30 days.

Licensing Program Analyst (LPA) Soleil Marx, met with Director, Shannon Roberts, for the purpose of conducting a complaint investigation alleging that staff groomed a child's hair without consent from the responsible party. Throughout the course of the investigation, LPA made observations, conducted interviews, and reviewed records. It was revealed that hair accessories were cut out of a child's hair. Interviews conducted with staff and children revealed consistent statements that a child's hair ribbon was cut out using scissors due to the child requesting it be taken out while crying of pain that their hair was too tight during nap time. It was stated that staff were unable to remove or loosen the hair ribbon without cutting it, so it was removed with scissors and put in a bag for authorized representative to retrieve at pick up. LPA did not observe any documentation requesting that staff refrain from touching the child's hair prior to this incident. Review of parent handbook states to send child to school in comfortable play attire and that clothing and hair may get messy. Staff statements were consistent in that hair accessories are removed if a child requests it, it is causing a child pain, or interfering with their ability to particiapate in activities. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
