On 06/11/2024, Licensing Program Analyst (LPA) Ka Vang conducted an unannounced Annual Required Inspection and was met by Director Benita Luna. The facility is operating a year-round schedule, Monday to Friday, from 6:30 a.m. to 5:30 p.m. LPA confirmed the facility has a working telephone service at (559) 222-8878. This facility provides meals to the children in care. The food is prepared on site. Menus are posted at least one week in advance where an authorized representative can view them.

LPA toured the facility indoors and outdoors, and a census was taken. During the inspection, LPA observed that not all the children were under supervision, including visual supervision, of a qualified teacher at all times. LPA observed that there was a lack of supervision in Room #5; therefore, a deficiency of Type A was cited during today’s inspection. See LIC809-D page. A civil penalty of $500 was also assessed as this regulation was violated. Director understands that there shall be a ratio of one teacher supervising no more than twelve children in attendance.

There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible to children. No poisons were observed during the inspection.

During the inspection, LPA observed furniture and equipment are in good condition, free of sharp, loose, or pointed parts. All toilets and handwashing facilities are in safe and sanitary operating condition. All floors are clean and safe. All kitchen, food preparation and storage areas are clean. The facility is free of flies, insects, and rodents. Facility has one or more functioning carbon monoxide detectors that meet the statutory requirements. Solid waste storage containers have tight-fitting covers and are in good repair. Drinking water is available both indoors and outdoors as drinking water is provided by water dispenser and disposable cups.


Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). Based on observation, the licensee did not comply with the section cited above. LPA arrived at the daycare facility at 11:55 a.m., LPA was greeted by staff #1 (S1) who was supposed to be in Room #5 supervised the napping children. LPA observed that from 11:55 a.m. to 12:15 p.m., Staff #1 was assisting LPA and the children in Room #5 were not supervised. Licensee failed to arrangement appropriate supervision care in Room #5 while S1 assisted LPA. LPA observed that the children in Room #5 are ages between two to four year old. Due to the lack of supervision, there is an immediate health, safety, or personal rights risk to children in care. A civil penalty of $500 was assessment during this inspection.

Per Director, she will develop a training plan to ensure that her and her staff understands Title 22 regulations pertaining to Children's Personal Rights, children napping and proper constant visual supervision. Director is to submit written proof indicate that her and her staff understands the regulations. Director will submit the plan of correction to the Department by 6/13/24.

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

There is a working fire extinguisher and carbon monoxide detector and adequate heating and ventilation for safety and comfort. Fire drills are conducted and documented with the date, time and how many children present, every six months.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Upon notification from the Department, Director will comply and act immediately to terminate the employment of, remove from the facility or bar from entering the facility for any person it is deemed necessary while the Department considers granting or denying an exemption. Capacity and limitations as specified on the license are being maintained.

LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. LPA reviewed a sample of staff files and observed files were complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training.



At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. During record review, all staff have mandated child abuse reporting training. (Continued on LIC809-C).

The name of the child care center director or fully qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA and Director discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, there is a deficiency cited during today’s inspection. (See page LIC809-D for additional information).

Upon receipt of a Type A violation, Director shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports were given to Director.

Director was provided a copy of appeal rights. A notice of site visit (LIC 9213) was given and must remain posted for 30 days. This report shall be made available to the public upon request. Exit interview conducted and report was reviewed with Director Benita Luna.
