25 | On 9/25/2024, Licensing Program Analysts (LPAs), Valentin Hernandez and Anita Tristan met with Lead Teacher, Tracy De Los Santos and Site Supervisor, Jacqueline Burrell for an unannounced case management-incident inspection. LPAs toured the facility, and a census was taken. An Unusual Incident Report was submitted to the Fresno Community Care Licensing Office (CCL) regarding an incident that occurred on 8/29/2024, were there was inappropriate touching between two children during nap time.
Based on the information obtained through witness’ statements and interviews conducted there is a ponderance of evidence that this incident did occur. There was a lead teacher and three substitutes present, attending to toileting and calming the children for nap time. However, a 5-foot wall obstructed the staff’s line of sight, preventing them from seeing the children, which allowed the two children to conduct inappropriate touching.
Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D) Licensee was provided a copy of their appeal rights.
