On 9/25/2024, Licensing Program Analysts (LPAs), Valentin Hernandez and Anita Tristan met with Lead Teacher, Tracy De Los Santos and Site Supervisor, Jacqueline Burrell for an unannounced case management-incident inspection. LPAs toured the facility, and a census was taken. An Unusual Incident Report was submitted to the Fresno Community Care Licensing Office (CCL) regarding an incident that occurred on 8/29/2024, were there was inappropriate touching between two children during nap time.

Based on the information obtained through witness’ statements and interviews conducted there is a ponderance of evidence that this incident did occur. There was a lead teacher and three substitutes present, attending to toileting and calming the children for nap time. However, a 5-foot wall obstructed the staff’s line of sight, preventing them from seeing the children, which allowed the two children to conduct inappropriate touching.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D) Licensee was provided a copy of their appeal rights.

Exit interview conducted with Site Supervisor, Jacqueline Burrell. This report is to be made available to the public upon request. LIC 9213 Notice of Site Visit to be posted for 30 days.

Per health and safety supervisor they will be ordering mirrors that will be installed in the classroom to allow visual line of sight of staff. Safety supervisor will submit order invoice and pictures of installed mirrors to CCLD by POC due of 10/09/2024.

This requirement was not met as evidenced by: information obtained via an unusual incident report and witness statements for two children to conduct inappropriate touching. The lack of supervision made by a 5-foot wall that obstructed the staff’s line of sight This poses risk to the health, safety and or personal rights of children in care.
