On 03/11/2024 Licensing Program Manager (LPM) Juvenal Moctezuma and Licensing Program Analyst (LPA) Stephanie Vega-Gonzalez met with Site Supervisor, Jacqueline Burrell, also present was FUSD, Health and Safety Supervisor, Charlotte Miranda, FUSD Program Manager of Operations Leah Diaz, FUSD Program Manger, Laura Mitchell for an Informal Conference at the Fresno Regional Office.

The purpose of the informal conference was to discuss previous deficiencies cited during past inspections and to discuss the substantiated complaint inspection that was conducted on January 25, 2024. LPM Moctezuma reviewed and discussed the deficiencies with Site Supervisor, Jacqueline Burrell and how the Child Care Center will maintain compliance with the deficiencies cited below. Site Supervisor, Jacqueline Burrell has implemented a plan of correction since facility was cited.

The Department of Social Services, Community Care Licensing Division has determined that FUSD-SCANDINAVIAN Child Development Center violated licensing regulations pertaining to the operation of a Child Care Center:
The following Type A violations were discussed:

· On 01/25/2024 – CCR 101223(a)(3) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights:(3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature... This requirement was not met as evidence by, Staff 1 violated Child 1's personal rights on 01/11/2024.


The following Type B violations were discussed:

· On 02/27/2023 – CCR 101239(n) Fixture, Furniture, Equipment and Supplies (n) Furniture and equipment shall be maintained in good condition, free of sharp, loose or pointed parts. This requirement was not met as evidence by, Various boxes and items stacked on top of children’s furniture and counter space, which could potentially fall on a child.

· On 02/27/2023 – HSC 1596.8662(b)(1) Administration of Child Care. On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs.... This requirement was not met as evidence by, staff did not renew their mandated reporter.

· On 02/27/2023 – CCR 101217(d) Personnel Records, (d) All individuals subject to criminal record review shall, be fingerprinted and sign a Criminal Record Statement (LIC 508 [Rev. 1/03]) under penalty of perjury. This requirement was not met as evidence by, Director and a staff member did not have a file at facility for licensing to review. Director and staff did not have a file on site. Staff was a substitute and did not have the required licensing forms.
· On 02/27/2023 – CCR 101223(b)(1) Personal Rights, (b) The center shall inform each child's authorized representative of the rights specified in (a) (1) through (8) above. (1) The center shall give each authorized representative a copy of the Personal Rights form (LIC 613A [9/96]). This requirement was not met as evidence by, Four children did not have the required LIC613A personal rights documentation on file.
· On 02/16/2022 – HSC 1596.8662(b)(1), On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs...Administration of Child Care Licensing: . · On 02/16/2022 – CCR 101238(g), Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. Buildings and Grounds: . This requirement was not met as evidence by, Disinfectants and cleaning solutions found under the sink that were accessible to children in care. The door to that area does not close all the way and has a broken hinge.
Compliance Plan
In response to the discussions, the licensee had agreed to the following:
1. Licensee will ensure children are provided with a safe and healthful environment.
2. Licensee will ensure that all staff & children files are complete for licensing to review during an inspection.
3. Licensee will submit a written plan on how they will ensure that: poisons, detergents, cleaning compounds, medicines, and other items that could pose a danger, are inaccessible to children in care.
4. Licensee will ensure that all personnel will be given ongoing on-the-job training in areas of childcare supervision, reporting requirements, & personal rights including communication.
5. Licensee will ensure that all volunteers will be given ongoing on-the-job training and such training shall be appropriate to the job assigned and shall be evidenced by a safe and effective job performance.
6. Licensee will submit a written action plan on how they will meet items listed above and how the facility will adhere to Title 22 Regulations.
Today, Licensee was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. LPA also went over (TSP) Technical Support program.
Licensee shall submit a written plan to Community Care Licensing Division by April 12, 2024 indicating how they will comply with the above requirements. Licensee was informed that training videos are available on the Community Care Licensing website at

Licensee will stay in compliance with Title 22, Division 12, Chapter 1 regulations at all times.
A copy of the signed report and appeal rights were provided to Site Supervisor, Jacqueline Burrell.
No Deficiencies Cited during today’s Office Visit.
