On 6/7/24, Licensing Program Analyst (LPA) Priscilla Zamudio conducted an unannounced case management inspection. LPA met with Site Supervisor, Luis Figueroa to discuss an incident which occurred on 5/30/24. A census was also taken. LPA interviewed staff, reviewed pertinent information and observed where the incident occurred.

On 5/30/24, at approximately 10:00am, staff#1 reported observed interactions between staff#2 and child#1. Staff#1 observed child#1 hitting staff#2 and then staff#2 pushed child#1 away on the arm telling them not to hit. Child#1 attempted to get a toy from staff#2 and then staff#2 hit child#1 twice with the toy in hand. Child#1 cried but did not have any visible injuries. Staff#2 informed site supervisor that “it was not hard, more of a tap”.

Based on information gathered and interviews conducted by LPA, staff were found to be in violation of the child’s personal rights.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is cited (see LIC809D).

Exit interview conducted and report was reviewed with Site Supervisor, Luis Figueroa.

This report shall be made available to the public upon request. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Facility has taken steps to remedy the situation by providing training to all staff. Staff#2 was sent home for the day after the incident and will not be allowed until conclusion of investigation by FUSD HR Department, regarding the incident.
Deficiency cleared.

Based on interview and record review, the licensee did not comply with the section cited above. Staff hit/tapped child with a toy which poses a potential health, safety, or personal rights risk to persons in care.
