On 01/21/2026, Licensing Program Analyst (LPA) Ka Vang and Licensing Program Manager (LPM) Kari McWilliams conducted an unannounced inspection. The purpose of today’s inspection was to deliver the finding regarding the above listed allegation. LPA and LPM met with Director Jean Herrera. A tour of the facility was conducted, and a census was taken.

Throughout the course of the investigation, LPA conducted facility inspections, records review, and observations of the facility. LPA also interviewed Licensee, staff members, parents, and obtained pertinent records for this investigation. The evidence obtained revealed that there was an incident that occurred in the facility where a daycare child sustained a finger amputation injury in the outdoor activity space. At the time the child sustained the injury, the staff member who was supervising the children in the outdoor playground did not have direct visual supervision of the child. The injury occurred when the child twisted her hand and fingers within the nylon basketball hoop net. It was determined that staff failed to provide adequate supervision resulting in a daycare child sustaining an injury.

Based on the investigation, the preponderance of evidence has been met that staff did not provide adequate supervision resulting in daycare child sustaining an injury; therefore, the above allegation is found to be SUBSTANTIATED.

Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, the following deficiency is being cited during today’s inspection: (See next page, LIC809-D). An enhanced civil penalty was also assessed with this citation.

LPA and LPM informed Director Jean that this report dated 01/21/2026 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA and LPM informed the Director to provide a copy of this licensing report dated 01/21/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Director.

Exit interview conducted and report was reviewed with Director. Director was provided appeal rights.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

The facility immediately removed the basketball net from the hoop and will provide an alternative mechanism that will assist the ball coming safely through the hoop. Licensing Program Analyst (LPA) Vang observed that the nylon net on the basketball hoop had been removed.

Based on interviews and record review, it has been determined that a child sustained an amputation injury to their finger while playing with a basketball hoop net due to staff failing to provide adequate visual observation and supervision. This poses an immediate risk to the health, safety, and/or personal rights of children in care.

By 01/22/2026 facility will provide written proof that a protective measure has been implemented to ensure the basketball hoop is safe for the use without the net, and copy of the staff attendance sign-in sheets with the date of completion indicating that all staff members have been trained and understand children’s supervision requirements, children’s personal rights, and health and safety practices for children in care.
