25 | On 12/19/24, Licensing Program Analyst (LPA) Martha De Haro conducted an unannounced case management inspection. LPA toured the facility, and a census was taken. LPA met with Teacher Claribel Ventura. The purpose of today's inspection was to discuss an Unusual Incident, which was reported to have occurred on December 9, 2024. The Unusual Incident was received by the Community Care Licensing Office on December 18, 2024 stating that the parents disclosed during parent/teacher conferences on December 16, 2024 that Assistant #1 had injured child #1 at the facility.
During the case management inspection, LPA interviewed Teacher Ms. Ventura as well as Assistants #1 and #2, and the school principal. LPA received and gathered additional documentation.
After conducting the case management inspection and interviewing the teacher, two assistants, and the principal, it was found that child #1 has a history of putting things in her mouth such as chewing on her sleeve, chewing on her necklace, and chewing on her hair and is an active child in class. Regarding if the child was ever injured at the facility, one staff member indicated that child #1 tripped and fell in the playground on December 9, 2024 but appeared to be uninjured. Two other staff members denied that child #1 ever received any other injuries in or out of the classroom. Per teacher Ms. Ventura, child #1 was seen putting her hair, which was in a braid, in her mouth during the day on December 9, 2024 and the child was asked to sit next to Assistant #1 for a short period of time as the child was fidgeting and leaving her spot on the carpet. Ms. Ventura denied ever seeing Assistant #1 or Assistant #2 injure the child in any way. Assistant #1 denied ever intentionally injuring child #1 in any way. Once the principal was made aware of the incident by the parents, she took appropriate measures to investigate and address the incident, following appropriate policies, regulations, and reporting requirements.
Based on the information obtained via interviews, at this time, LPA cannot determine if the child was injured at the facility due to the time frame as parents reported the incident to the school one week after the alleged injury occurred during parent/teacher conferences on December 16, 2024.
Per Chapter 1, Division 12, Title 22 of the California Code of Regulations, no deficiencies are cited during today’s inspection.
A notice of site visit was given and must remain posted for 30 days. Exit interview conducted with teacher Claribel Ventura and a copy of the report and appeal rights were given and discussed.
