On 08/15/2022 Licensing Program Analyst (LPA) Araceli Gibson, conducted an unannounced annual inspection. LPA met with New Director Samantha Rodriguez. The preschool had a census of 28 and a Toddler component of 7 children 3 in care today are infants. LPA toured the facility, both indoors and outdoors to inspect areas accessible to children in care. New Life Discovery Preschool runs a year round program. Monday through Friday from 7:00 AM to 6:00 PM

There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible. No poisons were observed during the inspection.

Furniture and equipment are in good condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space and playground equipment is maintained in a safe condition. LPA Gibson advised Site Supervisor as a best practice to rake the wood chips surrounding the high impact play structures routinely for added safety. All toilets and handwashing facilities are in safe and sanitary operating condition. Floors in the facility are clean and safe. All kitchen, food preparation and storage areas are clean, free of litter/rubbish and free of rodents/vermin. All food is protected against contamination and any contaminated food is discarded immediately. Solid waste storage containers have tight-fitting covers and are in good repair. Drinking water is available both indoors and outdoors. The facility is free of flies, insects and rodents. Facility has one or more functioning carbon monoxide detectors that meet statutory requirements. LPA observed smoke detector not working. Staff purchased a new one to meet compliance. Prior to working or volunteering in a licensed child care facility, all individuals subject to a criminal record review have received a criminal record clearance or exemption. LPA observed Staff 3 working and caring for children upon record review discovered Staff 3 had been disassociated on July 12, 2022 per Guardian and verified by CCLD staff (see 809D). Upon notification from the Department, the licensee will comply and act immediately to terminate the employment of, remove from the facility or bar from entering the facility for any person it is deemed necessary while the Department considers granting or denying an exemption. Capacity and limitations as specified on the license are being maintained. continue 809C

Based on observation and record review, the licensee did not comply with the section cited above in Staff #3 did not have criminial background clearance according to guardian roster. LPA confirm with Fresno Regional office the staff had been disassociated on 07/12/22. LPA observed this staff working and caring for children which poses a potential health, safety or personal rights risk to persons in care.

Based on record review the licensee did not comply with the section cited above Infant Teaccher stated she has not been documentating sleeping every 15 minutes with time or initial for staff observing infants sleeping. The toddler component classroom had 3 infants in care with no documentation.which poses a potential health, safety or personal rights risk to persons in care.

LPA reviewed Safe Sleep regulation for toddler component. Mats or cots are to be occupied by only one infant at time and cribs are kept free from all loose articles including blankets and pillows and there are no objects hanging above or attached to the crib. Infants are not swaddled while in care. LPA observed Staff physically checks on sleeping infants every fifteen minutes, however Infant Teacher stated they had not been documenting sleep for infants (See 809D.) Staff is checking for any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness and labored breathing. Staff-infant ratio requirements are being met while infants are sleeping.

At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. The name of the child care center director or fully-qualified teacher designated to act in the director’s absence has been reported to the Department. LPA discussed with the New Director it is important to have the Human Resources department to provided the director packet within 30 days of hire. Authorized Representative are signing children in/out of the facility and is being maintained, however there was one child missed out of 28 children. LPA reminded staff to double check daily. All children are under supervision, including visual supervision, of a teacher at all times. Facility maintains a ratio of one teacher supervising no more than 12 children in care when in person learning is conducted. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. LPA reviewed a sample of staff files and observed files were complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training. Menus are posted at least one week in advance where an authorized representative can view them.

Incidental Medical Services (IMS) are currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D) Licensee was provided a copy of their appeal rights.
