32 | The facility has not followed their facility handbook by implementing behavioral plans to mitigate the situation; therefore, the children’s behaviors have persisted. This poses an immediate risk to the health, safety, or personal rights of children in care. Based on the information obtained during the investigation, the allegation that that staff did not provide a safe environment for day care children was corroborated. The preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED.
Per California Code of Regulations, Title 22, Division 12, the following deficiency is being cited on the attached LIC 9099D, see next page.
Exit interview was conducted with assistant director Briana.
Upon receipt of a Type A violation, facility staff shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of LIC 9224 was given to assistant director Briana .
A copy of the report, notice of site visit and appeal rights were provided to director.
