On 08/02/2021, an announced case management visit was made by Licensing Program Analysts (LPAs) Luisa Gavoutian and Cynthia Brannon per Licensee’s request. LPAs met with Associate Program Director Renee Benell. This facility is located at the California State University, Fresno campus. This program will operate Monday through Friday, from 7:45 a.m. to 5:00 p.m.

During the annual inspection conducted on 07/14/2021, and inspection of the outdoor play area, LPAs Luisa Gavoutian and Stefanie Galvan had observed a pond adjacent to the outdoor play area outside of classrooms 10 and 24. LPAs had observed the pond and the children's outdoor play area were separated by a chain link fence. Director Brittney Randolph had stated on that date that the pond had always been there since the facility was licensed. The pond is not a licensed area for childcare, but Director had stated that the children sometimes take "field trips" into the pond area to take turns feeding the turtles.

LPAs had taken some measurements of the chain link fence on that date and found that it did not meet statutory requirements. The holes of the chain link fence were measured to be 2 1/4 inches, larger than the required maximum of 2 inches. LPAs had found the locking mechanism on the door of the fence to be approximately 16 inches from the top of the fence, as opposed to the required maximum of six inches from the top. LPAs found the gap between the bottom of the door to the dirt ground to be approximately five inches, as opposed to the required two inches. Additionally, the gate was not self-closing and self-latching. (Continued on LIC 809-C)

LPAs had observed that the fence door was fitted with a padlock and was locked. LPAs observed a large metal storage building located on the west side of the pond. The storage building had a door on the west side and the east side. The door on the west side is accessible through the children's outdoor play area. The door to the east side of the building is accessible from inside the pond area. LPAs did not observe any fencing that would prevent access from the storage building into the pond area. During the inspection, LPAs observed the west door of the building to be locked with a key lock. Director stated that only teachers access that building, about twice per year, when children are not present, to fire up clay. Director stated that the doors of the storage building remain locked at all times.

On 07/14/2021, LPAs took photographs of the pond, the fence, and the storage building. LPAs had a verbal conversation with Director regarding the fencing surrounding the body of water and advised that the fence be replaced or amended to bring it up to code with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code as stated in California Code of Regulation section 101238(e). LPAs asked that the facility replace or make amends to the existing fence within 30 days. Today, LPAs discussed the pond fencing regulatory requirements once again with Associate Program Director Renee Benell. LPAs were provided with a copy of the work order that was submitted to maintenance on 07/16/2021.

Community Care Licensing (CCL) should be notified when fencing has been replaced so an inspection of the new fencing could be completed. Renee was reminded that children must have signed field trip permission slips on file in order to access the pond area.

Exit interview was conducted with Associate Program Director Renee Benell. LIC 9213 Notice of Site Visit to be posted for 30 days.
