On 6/14/2022 an unannounced Annual inspection was conducted today by Licensing Program Analyst, (LPA) Stephanie Vega-Gonzalez and Jeovanna Yanez. LPA met with Teacher Yeleini Lopez and toured the facility, both indoors and outdoors. Director and assistant director were not present during the inspection, and LPAs were unable to review Designation of Facility Responsibility (LIC 309) to verity the fully qualified teacher designated to act on the director’s absence. The LPA observed all required licensing forms to be posted in a visible location for authorized representatives to view them. A census was taken and there were 14 day care children present. This facility runs Monday to Friday from 6:30 a.m. to 5:30 p.m.

LPA discussed with teacher that furniture and equipment need to be in good condition, free of sharp, loose or pointed parts. Floors in the facility are clean and safe. There is Adequate heating and ventilation for safety and comfort. All materials and surfaces accessible to children are toxic free. All toilets and hand washing facilities are in safe and sanitary operating condition. Menus are posted at least one a week in advance where an authorized representative can view them. All kitchen, food preparation and storage areas are clean, free of litter/rubbish and free of rodents/vermin. All foods/beverages capable of rapid spoiling are stored in covered containers at 45 (F) degrees or less. Drinking water is available both indoors and outdoors. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. Areas around high climbing equipment, slides have cushioning material to absorb falls. Solid waste storage containers have tight-fitting covers and are in good repair. The facility is free of flies, insects, and rodents. The LPA did not observe disinfectants, cleaning solutions and other dangerous items to be accessible to children. There were no poisons observed on the premises accessible to children. Licensee is aware that poisons are required to be locked and inaccessible to children. need

LPAs were not able to review children's file on this date. LPAs will return and complete file reviews on another date. LPAs were not able to review staff's file on this date. The name of the child care center director or fully qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. All children are under supervision, including visual supervision, of a teacher at all times. There is a ratio of one teacher supervising no more than 12 children in attendance. Capacity and limitations as specified on the license are being maintained.

There is no swimming pool or other bodies of water on the premises. Firearms/weapons or ammunition are not allowed or stored on the premises. There is a working fire extinguisher, smoke detector, carbon monoxide indicator, that meet statutory requirements. This facility had one person trained in CPR and first aid. LPA reviewed with Yeleini Lopez the Mandated Child Abuse Reporter Training (AB 1207), Yeleini Lopez is aware that the Mandated Reporter Training is required to be updated every two years. Information was discussed regarding the AB 1207 and the website to use. Information on Lead Poisoning was posted on the parent board. LPAs were not able to verify Fire drills.

Incidental Medical Services (IMS) are not currently being provided. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The facility was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. There are no excluded individuals present at this facility. Licensee is aware that upon notice from the Department, any excluded individual must be immediately removed from the facility and prevented from returning to the center or having contact with children in care. The licensee shall comply with the notice.

LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

To improve the quality and value of the new inspection process, a survey will be sent to the email address provided. Please complete the survey and share your inspection experience. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights.

A notice of site visit was given and must remain posted for 30 days.

Due to time restrictions, an annual continuation visit will take place at a later time.

Exit interview conducted and report was reviewed with the facility representative Yeleini Lopez.

Based on observation and interview, the licensee did not comply with the section cited above. Upon arrival LPAs met with Staff #1 who stated they was currently the person in charge. Both Director and Assistant Director were not present. LPAs were unable to review Designation of Facility Responsibility (LIC 308) and other documentation to verify that staff #1 is designatined to act on the Director's absence. This poses a potential health, safety or personal rights risk to persons in care.

Staff #1 stated they were are unable to provide LPAs children and staff records due to records being locked in cabinet and only available to Director via key. LPAs were unable to review records which poses a potential health, safety, or personal rights risk to persons in care.
