32 | The facility is operating within the capacity and limitations specified on the license. At least one staff member certified in CPR and Pediatric First Aid is present during operating hours and offsite activities. The name of the director or fully qualified teacher(s) designated to act in the director's absence has been reported to the Department. All children are under supervision, including visual supervision, at all times. The facility maintains required teacher-to-child ratios.
LPA reviewed a sample of children's files and observed that they contained complete and up-to-date contact information for authorized representatives or other responsible parties, as well as medical assessments. Infant files included an Infant Needs and Services Plan and an Individual Infant Sleeping Plan. A sample of staff files was also reviewed and found to be complete with required documentation, including health screenings, immunization records for influenza, pertussis, and measles, and current mandated reporter training certificates. Staff caring for infants meet required educational qualifications.
LPA discussed the Community Care Licensing website (www.ccld.ca.gov) as a resource for regulations, forms, Provider Information Notices (PINs), and quarterly updates. Reporting requirements under Title 22, Section 101212 were reviewed.
Licensee Sandra Dermer was reminded that all adults aged 18 and older—including employees and volunteers, unless exempted under Health and Safety Code Section 1596.871—must have a criminal record clearance or exemption, or have their existing clearance or exemption transferred before they are present at the facility. A civil penalty of $100 per day, up to five days per person (or up to 30 days for repeat violations), will be assessed for noncompliance with this requirement.
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers constructed before January 1, 2010, to test their drinking and food preparation water for lead contamination by January 1, 2023, and every five years thereafter. For licenses issued after July 1, 2022, the licensee must conduct lead testing within 180 days of licensure, per Written Directives Section 101700 (PIN 21-21.1-CCP). LPA verified that lead testing was completed in accordance with these directives and referred Licensee Sandra Dermer to the Department’s lead information webpage: www.cdss.ca.gov/inforesources/child-care-licensing/water-testing-information.
