On 08/17/2021, an informal office meeting was conducted at the Fresno Regional Child Care Office. In attendance at the meeting was Licensees Tia Lam, Licensing Program Manager (LPM) Alice Juarez, and Licensing Program Analysts (LPAs) Luisa Gavoutian and Stefanie Galvan. The purpose of the office meeting was to discuss recent and recurring violations of California Code of Regulations, Title 22.

The following Type B violations were discussed:

· 01/22/2020 – 101216.2(e) Teacher Aide Qualifications and Duties; “An aide shall work only under the direct supervision of a teacher.” On 01/22/2020, LPA Gavoutian arrived at the facility at 8:30 a.m. and observed Staff 2 and Staff 3 supervising five children in attendance. Personnel records were reviewed, and LPA Gavoutian observed that Staff 2 had completed nine child development units and Staff 3 has completed three child development units. Later, LPA and Director Van went back into the preschool classroom and observed Staff 3 providing care and supervision alone. Based on observation and records reviewed, Staff 2 was not qualified to supervise Staff 3. Furthermore, Staff 3 was not qualified to provide care and supervision to children alone.

· 12/12/2019 – 101238(a) Buildings and Grounds; “The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.” On 12/11/2019, LPA Gavoutian observed Licensee, Van Lam, replacing one of the smoke detectors in the facility. LPA Gavoutian later tested the smoke detector and found it to be operable. During the inspection, LPA Gavoutian also heard other smoke detectors beeping in the facility, indicating requirement to have batteries replaced.

· 12/11/2019 – 101229(a)(1) Responsibility for Providing Care and Supervision; “No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.” On 12/11/2019, LPA Gavoutian observed that all staff members supervising napping children in the preschool classroom were eating lunch at the same time. Later during nap time, LPA Gavoutian observed one staff member working on other projects in the classroom where children were napping. Later at around 2:25 p.m., LPA Gavoutian and Licensee Tia were in the girl’s restroom and observed one preschool child come in alone to use the restroom. This was a repeat violation of a deficiency that was cited on 06/05/2019 and the facility was issued a civil penalty in the amount of $250.00.

· 12/11/2019 – 101239(e)(4) Fixtures, Furniture, Equipment and Supplies; “All toilets, handwashing and bathing facilities shall be maintained in safe and sanitary operating condition. Additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities.” On 12/11/2019, LPA Gavoutian observed the following in the boy’s restroom: soap dispensers did not contain soap and no paper towels were available; exposed rusty bolts on all toilets; dried urine spots on the far-left toilet; leaky faucet on far-left sink; puddle on the ground next to the second toilet from the left. LPA observed the following in the girl’s restroom: exposed rusty bolts on all toilets; toilet on the far right not secured to the ground; rust on the second and third sinks from the left; soap dispensers did not contain soap and no paper towels were available; large puddle of water on the ground in the middle of the restroom coming from a pipe leak from the sink on the far left.

· 12/11/2019 – 101229.1(a)(1) Sign In and Sign Out; “The person who signs the child in/out shall use his/her full legal signature and shall record the time of day.” On 12/11/2019, LPA Gavoutian reviewed sign-in/sign-out records and observed that none of the parents/authorized representatives were using their full legal signature; the parents/authorized representatives were only recording the time of day when the child is dropped off or picked up; staff did not sign in/out the children who are removed from the facility to be transported to and from school; some children were present with no signature or time recorded.

· 12/11/2019 – 101221(a) Child’s Records; “A separate, complete and current record for each child is maintained in the child care center.” On 12/11/2019, LPA Gavoutian reviewed eight preschool children’s files, six infant children’s files, and four school age children’s files. Of the files reviewed LPA Gavoutian observed that three did not contain a signed admission’s agreement; 10 did not contain physician’s reports; six did not contain immunization records; 13 did not contain TB test assessment; one child was present who did not have a facility file.

· 12/11/2019 – 101217(a) Personnel Records; “The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee.” On 12/11/2019, LPA Gavoutian reviewed six staff files and observed two files did not contain a health screening; one file did not contain record of immunizations for measles and pertussis and four did not contain record of influenza.

· 12/11/2019 – 1596.8662(b)(3) Availability of information regarding detecting and reporting child abuse and neglect; training for mandated reporter who is licensed day care provider, administrator, or employee of a licensed child day care facility; proof of completion; “On and after January 1, 2018, a person who becomes an administrator or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a) within the first 90 days that he or she is employed at the facility and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.” On 12/11/2019, LPA Gavoutian reviewed six staff files and observed six records did not contain documentation of AB1207 mandated reporter certificates.

· 12/11/2019 – 1596.8595(c)(1) Posting licensing report by child care facility or home; duration of posting; civil penalty for failure to comply; reports to be provided to parents or guardian of each child receiving services; “A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as set forth in paragraph (1) of subdivision (a) of Section 1596.893b.” On 12/11/2019, LPA Gavoutian reviewed eight preschool children’s files, six infant children’s files, and four school age children’s files. Of the files reviewed LPA Gavoutian observed that eight did not contain signed LIC 9224 – Acknowledgement of Receipt of Licensing Reports for a Type A deficiency that was cited during a case management inspection conducted on 06/05/2019.

Licensee had submitted proof of corrections for the above-mentioned citations and the deficiencies were cleared. Licensee has held staff meetings and submitted copies of the agendas and attendance sheets where the above-mentioned allegations were discussed.

A previous informal office meeting was conducted at the Fresno Regional Child Care Office on 08/29/2019 to discuss previous violations. Licensee was informed that any further repeats of the above allegations will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action.

A copy of this signed report and appeal rights were provided to Licensee Tia Lam.
