On 8/17/2021, an informal office meeting was conducted at the Fresno Regional Child Care Office. In attendance at the meeting were Licensee/Director Kunthear (Tia) Lam, Licensing Program Manager (LPM) Alice Juarez, and Licensing Program Analysts (LPAs) Luisa Gavoutian and Stefanie Galvan. The purpose of the office meeting was to discuss recent and recurring violations of California Code of Regulations, Title 22.

The following Type A violation was discussed:

6/28/2021 - 101429(a)(1) Responsibility for Providing Care and Supervision for Infants; "Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times." On 6/28/2021, LPAs Luisa Gavoutian and Stefanie Galvan observed two awake infants in the main classroom and one napping infant in the crib room. LPAs observed that Staff 1 was standing in the classroom near the wall that divides the main classroom and the room.

The following Type B violations were discussed:

6/28/2021 - 101439.1(f) Infant Care Center Sleeping Equipment; "Cribs shall be free from all loose articles and objects, including blankets and pillows." On 6/28/2021 LPAs Luisa Gavoutian and Stefanie Galvan observed Child 1 asleep in the nap room and was covered with a blanket. Licensee Tia immediately removed the blanket from the infant's crib and placed it away from the crib.

6/28/2021 - 101416.3(b) Infant Care Aide Qualifications and Duties; "An infant care aide shall work under the direct supervision of the director, the assistant director or a fully qualified teacher, except as provided for in Section 101416.5(d)(1)." On 6/28/2021, LPAs Luisa Gavoutian and Stefanie Galvan entered the infant classroom and observed that Staff 1 was in the infant classroom alone. LPAs reviewed Staff 1's records and found that Staff 1 has not completed the early childhood education or child development units required to provide care and supervision to infants alone.

6/28/2021 - 101223(a)(2) Personal Rights; "To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs." On 6/28/2021 LPAs Luisa Gavoutian and Stefanie Galvan observed in the infant classroom, Child 1 in a crib, which had been rolled out into the classroom area. Child 1 was awake and Staff 2 was interacting with Child 1 with a rattle. Staff 2 did not meet accommodations to the needs of Child 2, but instead handed Child 2 to Staff 2.

6/28/2021 - 101229.1(b) Sign In and Sign Out; "The person who brings the child to, and removes the child from the center, shall sign the child in/out." On 6/28/2021 LPAs Luisa Gavoutian and Stefanie Galvan attempted to review facility's sign-in/sign-out records and found only Child 3 and Child 4 has sign-in/sign-out records completed. Licensee stated that due to pandemic she was asking parents to complete sign-in/outs at the end of the month only.

12/12/2019 - 101439(d)(2) Infant Care Center Fixtures, Furniture, Equipment and Supplies; "A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Section 1596.846." On 12/12/2019 LPA Luisa Gavoutian observed a baby rocker being used.

12/12/2019 - 101238.2(d)(2) Outdoor Activity Space; "The surface of the outdoor activity space shall be maintained. Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard." On 12/12/2019 LPA Luisa Gavoutian observed an opening in the fence of the infant outdoor play area that leads into a larger field that contains various hazardous items such as two large tree trunks of trees that were recently removed, and various large items. LPA also observed this are also leads directly into the street. (Continued on LIC 809-C)

12/12/2019 - 101416.5(b) Staff-Infant Ratio; "There shall be a ratio of one teacher for every four infants in attendance." On 12/12/2019 LPA Luisa Gavoutian observed one teacher supervising six infants while other staff were on break.

12/12/2019 - 101419.3(a) Modifications to Infant Needs and Services Plan; "The written infant needs and services plan shall be updated at least quarterly, or as often as necessary to assure its accuracy." On 12/12/2019, LPA Luisa Gavoutian reviewed five infant records and found that three did not have a Needs and Services Plan updated quarterly.

Licensee had submitted proof of corrections for the above-mentioned citations and the deficiencies were cleared. Licensee has held staff meetings and submitted copies of the agendas and attendance sheets where the above-mentioned allegations were discussed.

A previous informal office meeting was conducted at the Fresno Regional Child Care Office on 08/29/2019 to discuss previous violations. Licensees are informed that any further repeats of the above allegations will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action.
