32 | The facility is operating within the capacity and limitations stated on its license. At least one staff member with current CPR and Pediatric First Aid certification is present at all times when children are in care, including during off-site activities. The name of the center director and any fully qualified teachers designated to act in the director's absence have been reported to the Department. Children are under visual supervision at all times, and staff-to-child ratios are being met.
LPA reviewed a sample of children's files and observed that they were complete, including emergency contact information, medical assessments, Infant Needs and Services Plans, and Individual Infant Sleeping Plans. Staff files reviewed included health screenings, immunization records for influenza, pertussis, and measles, as well as documentation of completed mandated reporter training. Staff caring for infants meet the required educational qualifications.
LPA discussed the Community Care Licensing website (www.ccld.ca.gov), which provides access to resources such as forms, regulations, Provider Information Notices (PINs), and Quarterly Updates. LPA also reviewed the Reporting Requirements under Section 101212.
Director Monica Curry was reminded that all adults 18 years and older—including staff and volunteers, unless exempt under Health and Safety Code Section 1596.871—must obtain or transfer a criminal record clearance or exemption before being present in the child care center. A civil penalty of $100 per day, per person (up to 5 days for a first violation or up to 30 days for repeat violations), may be assessed for noncompliance.
LPA discussed Assembly Bill (AB) 2370, which requires licensed child care centers constructed before January 1, 2010, to test their drinking and food preparation water for lead before January 1, 2023, and every five years thereafter. Facilities licensed after July 1, 2022, must test within 180 days of licensure per Written Directives Section 101700 (PIN 21-21.1-CCP). LPA verified that lead testing was completed in accordance with these directives. Safe sleep regulations were reviewed. LPA provided information about the Child Care Licensing Safe Sleep webpage and emphasized the importance of checking for recalled infant products on the U.S. Consumer Product Safety Commission (CPSC) website. LPA recommended that the facility register all infant devices with the CPSC to receive recall notifications. (Continued on LIC809-C)
