On 12/15/20, Licensing Program Analyst (LPA) Jose Penate conducted an unannounced complaint inspection to provide complaint findings. LPA met with Director, Ermelinda Perez. LPA discussed the allegation(s) and took a census. During the course of the complaint LPA interviewed staff, witnesses and reviewed facility records and viewed video surveillance from the facility. Based on video surveillance conducted and informaiton gathered, the preponderance of evidence standard has been met, therefore the above allegations of Director yells at daycare child(ren) and Director handled daycare child in a rough manner are found to be SUBSTANTIATED.

Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A completed signed copy of the LIC 9224 will be placed in each child's file.

Per California Code of Regulations, Title 22, Division 12, Chapter 3, these deficiencies are being cited on the attached LIC 9099D.

An exit interview conducted with Director, Ermelinda Perez. A copy of this report and Appeal Rights were provided and discussed with Ermelinda Perez.

A Notice of Site Inspection Form was posted to parent's board and must remain posted for 30 days.

Director stated that she will take a second prior to dealing with any situation that requires extra attention to a daycare child. She will think-breathe and then react on any situation.

evidenced by: Based on video observation, the director did not comply with the section cited above. LPA observed director grab child in a rough manner and put/place him down on the sleeping cot for nap. This is an immediate health & safety risk to children in care.

Director stated that she will take child to her office so she can speak to them and find out what the problem is. She will not make a child put his/her head down on table at any time.

evidenced by: Based on video observation, the director did not comply with the section cited above. LPA observed director instruct child to keep head down on table for a period of time. This poses a potential health, safety or personal rights risk to persons in care.
