On 10/18/2022, an Informal Conference meeting was conducted at the Fresno Regional Child Care Office. In attendance at this meeting were: Licensing Program Manager (LPM), Michael Duarte, Licensing Program Analysts (LPAs) Ka Vang and Cynthia Brannon, and Licensee, Nancy Alejandrez. The purpose of this meeting was to discuss the recent violations of Title 22 Regulations and Health and Safety Code.

The following citations were cited on 10/07/2022, by Community Care Licensing, and the following citations were discussed with Licensee, Nancy Alejandrez:

· Type A - 101229(a)(1): Responsibility for Providing Care and Supervision; (a) The licensee shall provide care and supervision as necessary to meet the children’s needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1).
· Type B - 101227(a)(4): Food Services; (a) In child care centers providing meals to children, the following shall apply: (4) Between meals, snacks shall be available for all children unless the food a child may eat is limited by dietary restrictions prescribed by a physician. Each snack shall include at least one serving from each of two or more of the four major food groups.
· Type B - 101223(a)(3): Personal Rights; (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting, or withholding of shelter, clothing, medication or aids to physical functioning.
· Type B - 101515(b): School-Age Child Care Center Director Qualifications and Duties; (b) All school-age child care centers shall have a director.

· Type B - 101538.2(b): Outdoor Activity Space for School-Age Children; (b) In combination programs, outdoor activity space provided for school-age child care center children shall be physically separated from space provided for other child care center children.
· Type B – 101212 : Reporting Requirements; (d) Upon the occurrence… a report shall be made to the Department by telephone or fax within the Department's next working day... In addition, a written report... shall be submitted... within seven days.... (1) Events reported shall include... (c) any unusual incident or child absence that threatens the physical or emotional health or safety of any child.

These citations pose a potential risk to the health, safety and/or personal rights of children in care. During 10/07/2022 visit, Licensee stated that she will submit proof of corrections for the above-mentioned citations to LPA by 10/21/2022.

During this meeting, it was discussed that violation of Title 22 Regulations and the Health and Safety Code and failure to maintain compliance will result in a Non-Compliance conference and that the licensee may be referred to the Legal Division for possible Administrative Action.

A copy of this report was given to Licensee Nancy Alejandrez. No deficiencies were cited during today’s meeting.
