32 | LPA Herrera reviewed staff qualifications and conducted interviews. Interviews conducted revealed inconsistent statements regarding whether unqualified staff were used in the capacity of fully qualified teachers. Therefore, although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
Although LPA Herrera was unable to observe the facility to be operating out of ratio, during records review LPA Herrera observed commingling and improper staffing for the number of children enrolled in the facility. Based on those findings, LPA Herrera was unable to determine with certainty whether the facility was operating within or out of ratio. Therefore, although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
